December 29, 2002 -- A Long Island homeowner blasted a would-be burglar with a .22-caliber pistol as the thug climbed through a window yesterday - and later said he has no regrets, although he was arrested.
"I would do it again, because you never know what these people are capable of," said Mark Freamon, 45, who faces weapons charges because cops say the Browning Challenger II semi-automatic handgun he used to protect his Inwood home is unlicensed.

"I would have been a whole lot sorrier had I not done it," he said. "But now I'm in legal trouble."

The incident, which left the burglary suspect only slightly wounded, began yesterday morning when Freamon heard noises and saw " a large black mass" outside the window of his home.

"Suddenly a body crashes through, I'm panicked, the adrenaline was rushing, and I instinctively racked the slide, pointed it to the middle [of the intruder] and fired four shots," Freamon said.

The intruder fell back through the window and Freamon called 911.

The intruder ran off, but police tracked suspect Edwin Murdaugh, 42, to a nearby house and arrested him.

Murdaugh was admitted to Jamaica Hospital and charged with second-degree burglary, cops said.

Freamon, meanwhile, was charged with fourth-degree weapons possession for the pistol, which he said he bought out of state.

He was given an appearance ticket and released.

Police also seized three legally owned rifles from Freamon's house, which he said had been burglarized before.

"I'm angry at [Murdaugh], but there's nothing I can do," Freamon said. "This leaves me in a bad situation; now I'm unarmed."

    Clerk Captures Robbery Suspect

    A lake area business worker helped "take a bite out of crime" in a big way.

    Lake Charles Police say a 15-year-old girl walked into the Homsi's Deli on Broad Street, armed with a gun, and demanded money from the clerk.

    In the process of taking the money out of the register the clerk and the suspect fought.

    Police say the girl ran out of the store. Detectives say the store clerk chased the would-be robber down the street and held her until officers arrived.

    The 15 year old is in the juvenile detention center on armed robbery charges.

    Budiriro man fires gun to frighten suspected robbers

    A Budiriro man was on Saturday forced to fire a gun to frighten two men, who allegedly attempted to rob him of $600 000 before he apprehended them.

    Rutendo Makaha (23) and Chrispen Madzirasa (28) were not so lucky as their victim, Mr Enock Samuriwo (28), who was armed with a revolver, is alleged to have fired a shot into the air, forcing the two to abandon their intention.

    In fear for their lives, the two immediately surrendered themselves to Samu-riwo, who subsequently took them to Glen View police post where he made a report and handed the two suspects.

    Makaha and Madzirasa yesterday appeared at Mbare Magistrates' Court facing allegations of attempted armed robbery.

    They were not asked to plead when they appeared before magistrate Mr Owen Murozvi and were remanded out of custody to January 13 next year on $20 000 bail each.

    For the State, Mr Richard Chikosha is alleging that on December 28, the two accosted Mr Samuriwo who was on his way to the bus terminus.

    It is alleged that Mr Samuriwo was at that time holding a small bag containing cash amounting to $600 000.

    Makaha is alleged to have grabbed the bag Samuriwo was holding, resulting in a scuffle between the two. On noticing that his colleague was in trouble, Madzirasa allegedly joined in but were overpowered by Mr Samuriwo, who pulled out his pistol and fired a single shot in the air.

    The shot, it is alleged, brought a spine-chilling shock into the two, forcing them to abandon their robbery escapade and gave themselves up.

    Stabbing victim had tried to rob couple earlier

    A 26-year-old man who died of stab wounds at Research Medical Center Saturday night suffered the wounds earlier that day while attempting to rob a Raytown couple, police confirmed today.

    Police have not released the deceased man's identity, pending notification of his family.

    The man was stabbed on Saturday when masked robbers, armed with handguns, confronted a Raytown businessman and his wife at their home in the area of 85th Terrace and Pershing in Raytown.

    The robbers may have followed the businessman home from work, said Lt. Wayne Wisner of the Raytown Police Department.

    Once they were inside the couples' home, the robbers separated the man and his wife and put them in different areas of the home. The husband struggled with one of the robbers and stabbed him.

    Both robbers fled and police notified area hospitals to watch for anyone seeking treatment for a stab wound. Within 30 minutes, Wisner said, Research officials contacted police. The suspect died of his wounds before he could be questioned.

    Neither the businessman or his wife was injured, police said.

    Officers found the stab victim's wallet at the scene, Wisner said. He was believed to be a Kansas City resident. Police searched a home in the 5700 block of Troost Avenue for additional evidence.

    Two women who drove the stab victim to the hospital were questioned and released.

    Police are continuing to investigate and are searching for the other robber. He was described as a black male, 5-feet-7 to 5-feet-10, weighing about 160 pounds. He was wearing a dark-colored shirt.

    Teens Arrested in Gun Shop Burglary

    (updated: December 30th, 6:40pm) Colonie Police arrest 4 teens who burglarized B & J Guns thanks to an alert snowplow operator.

    The snowplow operator was cleaning the parking lot of the mall where the store is located on Central Avenue when he noticed the teens smashing out the front window of the store around 5:20am Sunday morning. He immediately called the Colonie Police. Upon arrival, the police noticed a car with its lights off exiting the adjoining parking lot. Police pulled the car over on Karner Road in Colonie. After an investigation police found 22 handguns underneath a parked car in the adjoining parking lot.

    Police arrested all 4 subjects in the car and charged them burglary, grand larceny, and criminal possession of a weapon. Arrested were 16-year-old Jose Maldonado, 17-year-old Orlando Rodriquez, 18-year-old Roman Lopez, and 19-year-old Arfaxad Lopez all of Albany. Police believe the teens were going to sell the guns on the street. All four teens were remanded to Albany County Jail.

    Dangerous escaper captured in violent clash

    A dangerous escaped prisoner from Hillmorton Hospital has been recaptured in a violent clash at the Lyttelton road tunnel.

    Jacob Scanlan was pepper sprayed by police after he threatened to shoot them when he was cornered on a Christchurch-bound bus about 7.20am yesterday.

    Scanlan, 23, had been on the run since Friday afternoon, when he smashed his way out of the hospital, where he had been transferred while serving a five-year jail term for robbing Denny's Restaurant in Christchurch while armed with a baseball bat. Detectives warned that Scanlan was dangerous and should not be approached.

    Police were not aware of Scanlan's identity when they responded to reports of a man acting suspiciously around parked cars in Lyttelton. When tunnel security cameras filmed the man catching a bus, police intercepted the bus at the tunnel.

    Bus driver Rayner Bannan said the man was one of only two passengers on board the usually busy 7.15am service.

    Scanlan did not match the photograph of him on the front page of The Press yesterday because he had shaved his head and was wearing sunglasses.

    The first she knew of the problem was when police stopped her bus at the Heathcote end of the tunnel.

    "They jumped on the bus and started walking towards the back, and then the guy (Scanlan) got up and said: `I've got a gun; I'll shoot you'," she said.

    "The police told me to get off the bus, and the other passenger pushed the emergency button and jumped out the back door.

    "I left the cash box, but grabbed the key to the bus. I figured that I'm not going to let him get the bus.

    "The cops backed off, and the guy walked off to the front of the bus and looked at the money. The cops said something that I didn't quite pick up, and then (Scanlan) started on again: `I've got a gun; I'll bloody kill you'.

    "Then he started walking down the bus, and the other cop got on and they both pepper-sprayed him, from both directions. The pepper spray didn't seem to have much effect. The cops backed off, and he decided to make a run for it out the back door. He got about 10m before he was tackled by the police. He really fought them."

    Scanlan was overpowered and taken away by the police. The other passenger went home, and Ms Bannan then had to drive the pepper spray-reeking bus to Leopard's Opawa depot to replace it with another one to continue the service.

    Scanlan will appear in the Christchurch District Court today charged with escaping lawful custody.

    Soon after Scanlan's recapture, a Hornby man appeared in the Christchurch District Court charged with assisting his escape from Hillmorton Hospital. Shanon David Mann, 24, was remanded on bail without plea to appear again in January.

    Homeowner shoots and kills would-be robber

    (12/29/02) - A homeowner shoots and kills a man trying to break into his car.
    It happened just after midnight at some town homes on Shively Circle and Weldon in north Harris County.

    Police say the homeowner heard glass breaking outside. He came out with a gun and saw two men inside his car.

    Both suspects tried to run and the homeowner shot and killed one of the men. The other suspect got away

    The issue of self-defence was hotly debated this week when two women were arrested for killing men who allegedly attacked them.

    Agnes Mosakeng, 29, of Carletonville, west of Johannesburg, and Wilheminah Gole, 43, a tuck shop owner from Diepsloot, Johannesburg, were both arrested in connection with charges of murder after they fought off suspected assailants.

    Mosakeng and her boyfriend, Samuel Velumaleni, stabbed an intruder who broke into their home last Friday while Gole shot dead one of five robbers who broke into her home on Sunday.

    Police said Mosakeng and Velumaleni were arrested for murder because they had "exceeded the boundaries of personal defence". Mosakeng and Velumaleni are in custody pending a bail application while Gole was released on R1 000 bail after appearing in court this week.

    But this week lawyers warned that while everyone has a right to protect his or herself, the protection should not exceed what is needed to subdue an assailant.

    According to Johann Gresse, a member of the Criminal Law Committee of the Northern Provinces Law Society, the aim of self-defence is to ward off or subdue the perpetrator, not to kill .

    "You must not exceed more pressure than is necessary to subdue a criminal. The moment you continue to assault the person you can't rely on self-defence, because then you are committing a crime," said Gresse.

    Michael Trapido, a criminal attorney from Johannesburg, said the victim had to be able to convince the court that his or her life was in imminent danger.

    "In the case of the tuck shop owner she could argue that she felt that her life was in danger because she was up against five men, " said Trapido.

    But Lisa Vetten, gender co-coordinator at the Centre for the Study of Violence and Reconciliation, said it was very difficult to make rational decisions in such circumstances.

    " These people only have a couple of seconds to react and defend themselves. What might seem rational to them might not seem rational to the outside world.

    "They might think their life was in danger but others might not," said Vetten.

    She said that with the high incidence of rape in South Africa, women who found themselves in dangerous situations probably acted out of fear.

    Police spokesman Captain Piletji Sebola said it was up to the Department of Justice to decide whether to pursue the charges against Mosakeng, Velumaleni and Gole.

    He said it was routine to open a criminal case against someone who committed a murder, even if the person claimed to be acting in self-defence.

    "The Department of Justice will decide whether to pursue the murder charge or to change the charge to something like culpable homicide," said Sebola.

    Attempted Carjacking Turns Deadly
    Metro Police say an attempted carjacking turned deadly when the man being robbed turned his gun on the suspects.

    It happened early Sunday morning at the Golden Gallon on Haywood Lane in South Nashville. Police say two men tried to carjack the driver of a Ford Explorer.

    But the driver of the Explorer pulled out a gun and shot the suspect, who died at the scene. The other carjacking suspect was not hurt and has been arrested.

    Police say the driver did have a valid permit to carry a gun, but they are still investigating to see if any charges will be filed against him.
