Don't worry about the bullet with your name on it, worry about the fragmentation grenade addressed 'To Occupant'.

quote:Jeffrey and his 14-year-old brother Stephen, who allegedly urged Jeffrey to fire the spitball, both were charged with battery causing serious * injury, assault with a deadly weapon, assault by force likely to produce great * injury, and mayhem.

Spitballs are dangerous weapons eh?? Only in California.

Glad it wasn't like that when I was in school. For as many as I shot, probably would have made a visit to "ol' sparky" in Huntsville.

next step will be to register all straws and gum wrappers. I think a lot of folks here would have been sentenced to life in prison if this were the case a few years back.

I started home school when my son complained of boredom in the first grade. Sat in on his class room for three days to observe, and I couldn't blame him. They we're doing 25 piece puzzles in a corner. (He could put 150 piece together since he was 4.) The kids were learning to read with head phones, a book and a cassette recorder. (He could already read at 5th grade level in kindergarden.) The teacher mentioned to my husband and I that she was going to have 2 lesbians speak to his class about their relationship. (To explain the kid with 2 mommies)

They mentioned 2 boys in colorado who were being expelled for playing at shooting eachother on the playground. The teacher also took them aside and quizzed them whether or not their parents had any weapons at home. I enjoyed one listeners comment; Maybe they will start teaching our kids to surrender.

I'm teaching my son to shoot. Started out with a BBgun, then got him one with a scope. Bought him a nice 410, and we are signing up for a hunter's safety class before we hunt with it. He can already relate several rules for gun safety. Sorry to get off the subject. I am really tired of political correctness. We discuss History. He had a cow when we sold the Panama canal back. He was upset when He read about Truman not allowing McArthur into China. Dad's talk to your sons and train them up right! I'll shut up now. (smile)

Great post Ms. Mouse. You've saved your child from socialist brain washing. Too bad there aren't 50 million more like you.

Jeeze, Ms. Mouse, where the heck were you when I wuz single?! Tell your husband - if he doesn't already appreciate the fact - that he is one *lucky* guy!!

Loan shark, I have no doubt 'ol sparky' woulda been built for two & we woulda crossed into the great recess in the sky together.

Spitball = dangerous weapon. Man, that DA must have been the target of more than a few. Probably peed his pants in class. What a dipwad!

Just one more reason for me to move out of this state. Even though I live 200 miles north of San Franqueersco, I can still smell it.

What are these people thinking? Excuse me I forgot myself, lawyers don't think.
    1. Under the age of 14 years you have to prove that the child knew that the spitball could cause great * injury. At my age I don't even know that.
2.Mayhem is removing a body part, like Mike Tyson.
3.ADW is a specific intent crime. Did they prove he intended to hit anyone?
Was their attorney awake when this went to trial? I doesn't appear so.

Depends on what he fired the spit ball with - our favorite was the bic pen. This was never very accurate. I think any decent defence lawyer could prove the accuracy and intent theory. Maybe shoot a spit ball across the courtroom (at the DA) and ask the judge to pick targets. Lets see - how would you scope out a bic - then you got to go with a 5-10grn spit ball (depending on moisture content). If your using the blow method - I could see a scope, but if you go with the hand slam (pushing the ink tube back in to create pressure with another spitball - popping out the first one like a cork gun) then it is kind like "Hail Mary lets see where this one goes".......... Stupid idiots (THE DA and JUDGE)- We let our court systems get away with this kinda crap........

simonbs, me laddy, I'm guilty of gender stereotyping - not many guys can or would "stay at home" to school their children. You should note my reply was addressed to a "Ms." and predicated on the assumption the poster is female. I'll let your further comment pass in the interest of not responding to trollish remarks.

To begin with I think the little punk is lying, a spitball fired through a straw like we used to do is damn accurate, I bet he was aiming. I never heard of a gum wrapper spitball but that is aluminum and so would be harder than paper, this punk was trying to sting somebody pretty good. Eight years in Youth Prison and a felony is insane, he deserves what he would have gotten in my high school, 3 licks with Coach Allen's board and a week's suspension. But then, today 3 licks is Child Abuse, so there is no recourse but prison?

Actually there is significant evidence in Mouse's post that she is a woman.

"he teacher mentioned to my husband and I" (copied from her post)

    So you weren't stereotyping...
