Moving to Ny - Gun laws

rong2grong2g Member Posts: 5 ✭✭
edited April 2010 in General Discussion
Hey... I am new to the group, and I pretty much joined for one specific reason. I just found out that I will be moving to NY in the near future for work, and I currently live in Florida. I will be moving to Suffolk, or Nassau County in Long Island.

I own 4 pistols here in florida, and have every intention of bringing them to NY with me. I do have a concealed weapons permit, although I never carry.

Am I allowed to bring my guns? Do I have to sell them? I have read different things, but it looks like I have to try and apply for a permit, which my friends dad just got, and took upwards of a year to get, and he had to prove that he routinely carried large amounts of cash (he is a RETIRED banker), and he also needed references, etc. etc....

Can someone help me?

By law, you have to sell them to a person that goes by the name of "calrugerfan" on a public gun forum for no more than $1 each. Good luck in New York.

Obviously, I'm kidding. I can't really help you on this one but I'm sure somebody will be along shortly to help you. Some details on the guns might speed up the process though. Just make and model.

You're probably screwed. You'll probably have to apply for a permit to buy a handgun, not be able to bring yours legally into the state.

W-T-F would you leave sunny Florida for the armpit of America? Please tell me your getting a multi-million dollar raise for this move!

I bet money the mag cap on that XD is too high for NY

I was thinking the same thing.

rong2g -- Luckily, all of those are fairly common firearms. I could foresee major problems if you had certain guns that are considered to be more "evil."

Good luck on the CCW in NY.(Fat Chance of ever getting it).You will have to register everything U bring into the state,(Just like Joizy)IF you are even allowed to have all the guns on your list.
I would do some serious research on Transporting handguns to the state of NY. with the intent on staying there.
I have a feeling you will be longing to be back here, in Florida, before u ever even leave.

You should familiarize yourself with the laws, and do what you believe to be right. Ultimately, that decision is up to you.

If I HAD to move there, I know what I would do.

I live upstate, more handgun friendly then Long Island, permit process is long and drawn out, I would leave your handguns in Florida with someone you trust, until you get a New York permit. New York State has no sense of humor for unlicensed handguns. Check out www.handgunlaw.us/ for some general information regarding N.Y pistol permits

When I moved back to Upstate NY from Virginia in 2007, I had some handguns that I had purchased in Va. so were not on my NY permit. I stripped them down and shipped ONLY the receivers to an FFL dealer in NY. I went to my new county permit office to do an address change from my previous NY address. It took 6 months for it to be processed but I finally got my handguns. If I didn't already have a permit, they would probably still be at the dealer's!

Possession of an unregistered handgun in NY is a 3-year sentence (unless you're Plaxico Buress) and getting a permit is difficult. In your case, I would leave them in Florida until - or if - you are able to get a NY permit and then have them shipped to a local dealer. You will then need to get a "purchase permit" for each handgun in order to pick them up from the dealer. You will also need to fill out 4473's.

    Two better ideas:

    1. Sell them and save the money until you get a permit, which will take around 6 months IF the judge decides you need and deserve one; or
    2. Stay in Florida. NY State HATES handguns, especially downstate. They do not recognize ANY other state permits. [:(!]

Yes, possession of a magazine holding more than 10 rounds is a felony, unless it was manufactured prior to September, 1994. Springfield XD mags do not qualify as they were not made back then. I had to buy 10-rounders for my XD's.

In Nassau or Suffolk county , both on Long Island, you will have to go to the county police to apply for a permit. More then likely you will only be allowed to apply for a target shooting or hunting type of ccw. These two types allow you to carry either only to and from a rifle and pistol range, or while actively hunting only.A full carry is usually only granted for business reasons, and those are really tough to get, with all sorts of restrictions. you will need some local people vouch for your character. your having a ccw from any other state really means nothing to new york state.you will after 3-6-9-12 months get your n.y.state pistol permit, issued by the county you reside in, then you will have to get a purchase document from the county police, and pick up a handgun, then go back to the county police to have is registered on your license. the handgun serial# make and model will be typed onto your license. all of this also costs money.there may be more hoops to jump through now, as this is the way it was 8 years ago, when I lived there, might be a little tougher now. also, the permit you will get will not be honored anywhere within the n.y.city's 5 boroughs. good luck...Bob

Damn, you gun forum guys don't mess around with your response time!
Thanks to all for welcoming me in the community... I have no affiliation with Rong...

Ron is my name, G2G stands for "Go 2 Guy"... or when someone is annoying me, "got 2 go"...

To expand on my story... I am raised in New York, and have been in Florida for the last 4 or so years... Now it looks like my career might have me back doing sales in NY. The opportunity is very good... It is good enough for my fiancee to quit her career and re-locate, and be a stay at home mom if we decide to have kids...

My father who lives in Chicago, is retired from the police force. Maybe I can send my guns to him, and see if he can sell them, or hold them while I deal with the bureaucratic process in NY...

    Anyway, thanks for the advice

You really like to pick the anti-gun areas, don't you?

If by the anti-gun areas, you mean Chicago and Ny... I would have to agree... very bad coincidences...

I think my dad was just able to get a federal carry license, so I think he can hold my guns..... He has an identical Kimber though, except he got a .22 conversion kit (which keeps jamming)...

I could always just hide my guns real well, but I can never shoot them... I would still have them for piece of mind... And if I popped an intruder, I would do more time than him... LOL gotta love the LAW

I had a pocket knife confiscated in NY when I was going to the Statue of Liberty 5 years ago or so. They told me it was illegal.

I doubt their gun laws are any better.

    Good luck, and welcome.

I do love the law, THE LAW being, "...the right of the people to keep and bear arms, SHALL NOT BE INFRINGED."

That is THE LAW that limits government.

Too bad they ignore it. Perhaps the good folks of NY should ignore theirs.

The citizens of NY need to tell their elected leaders to go stuff a stick in their *.[:(!]

    Spider has the best answers.

Question, though....Where in NY are you headed?

It is NOT hard to get a license in NY as long as you are not too far downstate. I don't agree with the whole process but, it does stand right now so we have to deal with it.

Do not bring your pistols as it WILL get you a boatload of trouble if you get caught.

FROM wsfiredude: The citizens of NY need to tell their elected leaders to go stuff a stick in their *.

We have told them...the problem is that the state is run from the city and they WAY outnumber us. Sucks being us right now in that aspect.

The State has about 19 million people and NYC alone has over 9 million of those. Add in the other urban areas and we are in sad shape.

the full carry permit issued here is good statewide except for in the 5 boroughs of nyc.(WTH) leave your pistols in fla or transfer them to ny to a friend. you will have to apply for a nys permit before you can posess them here. once you get your permit they can be put on your's and you're legal. there are pro gun counties north of westchester (anti). forget the 5 boroughs of bloomberg-ville (nyc). contact the NYS Rifle and Pistol Association along with the pistol bureau at the sheriff's office of the county you want to move to for application procedure. better if you can stay off the island due to permit restrictions and head north few counties.

I know the handgun laws are pretty strict in NYC but you may need to see a judge and fill out numerous amounts of paperwork to possess a handgun in that neck of the woods

I lived in Nassau and Suffolk counties . You will never get a permit to carry and you can't own any pistols because they will be held by the police while you spend the rest of your life trying to get that target only use for any gun. Beware of clubs that say you can join and they can get you the proper permit to use a handgun at theirs or some public range. Ain't gonna happen . They take your money and that's about it. My childhood friends have been trying since we were in High School 39 years ago! Give your guns to a relative in Florida to keep for you. If you travel through NYC and get caught with a handgun it's 1 year mandatory jail time and kiss the gun good-bye.
