Hypothetical Auction Question

Auction ends. Winning bidder sends payment and FFL License. You ship the firearm to his FFL. He goes to pick it up and fails the background check.

What happens now with the firearm?

    Hypothetically, it belongs to his FFL dealer. He can sell it for the buyer who should have known he couldn't pass the background check.

    If you want it back, charge him a restocking fee. If not, it's his problem.

    Chatted with an FFL that received several guns for me. He said he'd have to ship it back to the seller, or the seller's FFL if the seller wasn't an FFL himself.

    He would expect the seller to pay return shipping though. If that was paid up front, it would sit in the collection. Had never happened, but that's what his thoughts were on it.

    The gun belongs to the buyer. He paid for it, and he owns it, even if he can't possess it.

    The receiving dealer can buy it from the buyer.

    The receiving dealer can offer to sell it for him on consignment.

    The receiving dealer can send it back to the selling dealer, and the selling dealer can decide whether to give the buyer a refund, full or partial.

    And hypthetically law enforcement interviews the buyer about the failed background check to determine if he just committed a felony. Hypothetically.

    If the seller was not an FFL it can go straight back to him. Same as you sending an item in for repair.

    Honestly it does not happen very often, but when it does we try to work it out. Sometimes we get the FFL to list it on GunBroker and it sells for more than the first time..... [:)]
