Going to list a factory Takorev cut away pistol on the other side. This shouldn't need an FFL to ship should it since it can't be fired? Thanks.

I think that you mean "to receive"; anyone can ship.

The answer is "it depends". ATF usually expects a "dewat" to have at least 2 cuts with removal of metal. Without our seeing photos, you will have to decide if it meets that standard.

Correct Neal, I did mean receive. It's just like the top right one:

Can't be fire...Or should not be fired? Big difference. Just because a firearm should not be fired doesn't mean it is no longer considered to be a firearm. Cut-aways are still firearms unless, as Neal said, they have been deactivated and these days that means the frame has been cut. Looking at the photos, what is there to stop someone from buying a new slide/barrel assembly and then tack welding a piece of sheet metal over the cut outs in the frame? Is it safe to shoot that way? No. Will it shoot that way? I'm betting it will and so does the BATF.

It might have to go to an FFL, but please do check your state and local laws, before you ship it. It is not exactly true that anyone can ship a handgun. USPS has their own rules of engagement, and handguns must be shipped by an FFL.

Some states also, like NY require that handguns are shipped by an FFL, and I think there are a handful more states that require that.

Only if the USPS is used. In many states, ANYONE can "ship" a handgun via common carrier, such as FedEx or UPS.
