Is it ok to do a FTF with someone in TN while I'm in AL on a rifle ? I know you that you could a few years back. Just trying to find out if things have changed. I know I can't with pistols. TIA

Sorry, I'm new to the site and can't quite get the search option to dig up the info I was looking for. I was wondering if it was legal to install a collapsible stock on a post-ban carbine. I purchased the rifle when the ban was in place and finally have the money to upgrade a few things on it, just wanted to stay legal. Any help would be greatly appreciated.

Can a New Hampshire private citizen
sell a handgun FTF to a Rhode island
private citizen while they are both
    in NH?
I've googled and read (it looks like no to me)
but I don't have the retention or comprehension
    I once had.
Please reply a guy has been bugging me fOR 3 DAYS.
    Thanks so much.

I have a friend who had his father pass away. He is selling his gun collection. One of the guns he has is a full auto from the 50's. He is not a class 3 dealer or has a class three license. I would like to purchase it, I can get a great deal on it. As soon as I can I will buy the class 3 stamp but how do we conduct this transaction legally?

WE HAVE THESE CLASS 111 QUESTIONS QUITE OFTEN. PLEASE CALL YOUR LOCAL BATF OFFICE. BE SURE, BE SAFE.

Contact your local ATF office. To legally possess and own an auto/sub you must have a class 3 license. However,I still might want to call them from a pay phone. Better yet, go to a web site called: impactguns.comThey'll for sure answer your questions without ant repercussions[if you know what I mean].Tideman

You do NOT have to have an FFL to own an NFA weapon. Individuals can own these weapons if they purchase a special tax stamp, have the transfer approved by their local law enforcement, and fill out the necessary ATF forms.Having said that, if the firearm in question is not already registered and the deceased gentleman did not have one of these special tax stamps, then the gun CANNOT be legally owned no matter what.

Don't be tempted to buy an illegal class 3 gun!!! Find a legal class 3 dealer, buy from him and sleep peacefully at night.

AntiqueDr is absolutely correct. At this point, the legal responsibility for disposal of the Class III firearm belongs to the executor of the estate. (Unless he is the executor, your friend cannot even temporarily possess the gun.) The executor can only 1) file BATF paperwork to transfer it to an individual named in the will, 2) transfer it to a Class III dealer, or 3) surrender it to a govt agency. If the gun was legally owned by the father, and ownership is not prohibited where you live, it sounds like you and the executor want to get together with a local Class III dealer who, for a fee, will take care of the paperwork. Since each transfer requires a tax stamp, you will need to pay for 2 of them.Neal

Thanks for the info guys. I will do my homework. At this time I am not sure that it is registered but that will be FIRST on my agenda before anything else. Thanks for keeping me out of prison.

Just so there is no misunderstanding... if the gun is not registered now, it can not be registered. It is forever contraband.
