I recently sold a Walther Model 9. Auction # 92112854. Buyer states he will send money order and a copy of his C&R. Can I ship this to him or should it be going through a FFL.

Not sure on this. Need help.

Thanks

The Model 9 hasn't been made since 1945, it is indeed a C&R eligible pistol.

True, but......you cannot ship if that would violate other laws in the buyer's city/county/state. You can look it up in ATF P 5300.5, available on the ATF website.

As Rich said- they are all over 50 yrs old, which makes them C&R weapons- but some states (California comes to mind) do not permit an 03 C&R FFL holder to receive HANDGUNS directly- they must go thru an 01 Dealer FFL. Where is your buyer?

the buyer is in florida. they also state that i can ship using ground shipment. as far as i know all pistols must be shipped next day air unless sent through a dealer in which case usps 3 day service can be used? i would like to get the buyer the cheapest shipping possible but also want to do it legally.

note this is just the frame and is not able to fire at this time. please refer to auction number above

    thanks for the help guys

A nonlicensee (that is, you) can only ship a handgun by UPS or Fedex Next Day Air. (A handgun frame is considered to be a handgun by ATF.)

If both the sender & recipient are dealers, a handgun may be sent USPS, whatever method they want.

Alas, only 01 Dealer FFLS, and Manufacturers can MAIL a handgun- those of us that hold an 03 FFL (Curio & Relics) cannot mail. Have been around this barn with the ATF, and yes, it IS in the regs. Does not just say "licensee", it says "licensed dealer or manufacturer". Believe me, I wish we could. We CAN mail long guns, but not pistolas. check if you can use UPS Air Saver.
