An unarmed man who was shot and killed by an Arizona police officer in January cried, complied with police orders and begged for his life before the fatal firing, according to a newly released police report.
Mesa Police Officer Philip Brailsford has been charged with second-degree murder for the death of Daniel Shaver, a 26-year-old Texas man. Authorities have declined to release Brailsford's body cam footage from the deadly encounter.
The night of his death, Shaver had invited a man and woman at the hotel to his room for drinks, according to the report.
After some shots of rum, the man asked Shaver about a case that appeared to hold a musical instrument. Shaver opened it to reveal a pellet gun and dead sparrow inside. Shaver told them he was on a business trip with Wal-Mart and "his job is to kill all of the birds that get inside the buildings," according to the report.
Shaver then briefly pointed the pellet gun out the window.
When police found Shaver, they warned him that he "may not survive" if he did anything that could be considered a threat, the report says.
Brailsford's body cam shows Shaver appeared to making small jerking motions while he had his hands behind his back., according to the report.
An officer yelled at him, "If you do that again, we are shooting you. Do you understand?"
"No, please don't shoot me," Shaver said.
The footage shows Shaver complying with all other orders, including a demand to crawl toward the officers, as he is "audibly heard sobbing."
At one point, Shaver's hand appeared to move toward his waist. An officer was heard yelling "Don't" before Brailsford fired.
Shaver was not armed. His hand motion appeared to be him "attempting to pull his shorts up as they were falling off," the report says.
Previous reports have indicated Shaver may have been drunk at the time of the shooting - despite telling officers he was not - and possibly did not understand police orders. Shaver's autopsy report has not been released.
Brailsford was charged with second-degree murder and fired from the department. The new report reveals Brailsford had etched on his rifle: "You're F---ed."
Shaver's widow and the mother of his two girls, Laney Sweet, posted a YouTube video this week saying prosecutors are considering a plea deal for the ex-cop. The Maricopa County Attorney has not commented on the case.
But a report released on Tuesday includes extensive description of the footage, detailing Shaver's desperate final moments before Brailsford fired five shots at him with an AR-15 rifle.

If the officer is tried, convicted and sent to prison, it could still be BS made up by a news agency. Just because the evidence and twelve jurors concluded his guilt doesn't mean the officer wasn't "railroaded".

No wonder cops hate body cameras.
The way they are shooting and killing unarmed citizens, (cops are civilians by the way, they are not covered by the UCMJ, so what else the hell are they but civilians that can run and hide like the New Orleans cops did during Katrina) I'm starting to care less and less about them getting shot.
They need to be proactive and police their ranks. Kick out the cowards and the incompetents witout waiting for a needless killing.

And if a differing opinion is laid out in tiny little words, with very simple concepts, some will still be left with nothing but strawman arguments and emotional nonsense.
Just like the BLM geniuses used. I am sure they enjoy the intellectual camaraderie. Some of us prefer to see what the evidence says, and actually wait for a jury to decide. Way to get ahead of the crowd...and the process.
Cops start out killing our dogs (because they're cowards and they really need to shoot something) .... and they get away with it, so now they have graduated to killing humans (because they really need to shoot something) and they are getting away with it most of the time.
I sure hope that no one truly thinks that it will get better.
Think of the irony here, a lot of critical statements were made when the cry was "Black lives matter" but now it's getting to the point that the cops are just killing anyone that they think they have any chance of making a lame excuse for.
I'm not a cop hater, to the contrary but this situation in America is getting pretty damn scary. Kind of makes you stop and think a moment before reaching in your pocket for your ID (when asked even).
If law enforcement officers are so afraid that they just kill first and then make up some boilerplate excuse after the fact .... then they are surely in the wrong line of work and are as big a threat as the scum that they are supposed to protect us from.

Given the far higher number of people killed by criminals, it seems a stretch to think the police are where we ought to focus our concern.

Instead of a "National Police Force" maybe we need "National police Standards". Some of these police departments simply hire the wrong people to be representing law and order[:(!]
We need more federal intervention in States Rights like we need a hairy droopy tit growing out of our forehead. There is no reason local Police forces can't set reasonable standards and hold LEO's accountable, as they do now. My observation is the new breed are quick to trigger and many may have a bit too much Rambo syndrome.
With that said; police shootings are rare considering the MILLIONS of police/citizen interactions that take place daily. It sounds like this Rambo was there with an itchy trigger finger and blew a guy away for UNJUST cause. The courts will sort it out.
