accidental discharge

We had an AD in our rifle range shed . An older disabled gentleman with his son . The older gent was shooting a lever action deer rifle from his wheel chair. He was bringing the rifle up to shoot and as he did he apparently cocked the hammer and it slipped and fired the rifle through the lower front wall. Only he and his son were on the range....I give him credit for calling and reporting the incident and offered to pay for damages.

My question is..on older lever action rifles, or new ones for that matter, Winchester or Marlin...if you start to cock the hammer and it slips from under your thumb, will the rifle fire?

It will fire on a winchester. Marlin has a safety on the lever where it shouldn't fire unless the lever is held in...

If it was scoped then he should have a hammer spur on it. If not then it is a pretty common scenario.

    I applaud his honesty.

We recently had (locally- about 10 miles away) ) a little 2 year old Girl struck in the back of the head by a ricochet off her swingset.

The Coward hid. After extensive interviews of all the surrounding neighbors and houses, a young boy volunteered that his Dad had been shooting, had shot a metal pole and it ricocheted off.

Would not want to be him in our local Jail. He is going to get his * handed to him. More than once.

Should have come forward with the truth from the get go.

I applaude the Gentleman for coming forward in an awkward and embarrasing situation.

+1 for calling it what is was...negligent discharge.

Unless a firearm literally goes off by itself, it isn't an accident, it is negligence.

Still had the Honesty to report himself, when no one else was around.

    That speaks to character.

Absolutely. Likely most would have slunk off without a word.

We as kids got them hammered into our heads.
And we learned the lever action guns were the most dangerous guns. The very action
of working the lever puts the gun into a fire ready state with a finger near the trigger.

    Exactly.
Some will die in hot pursuit
    And fiery auto crashes
Some will die in hot pursuit
    While sifting through my ashes
Some will fall in love with life
And drink it from a fountain
That is pouring like an avalanche
