edited February 2023 in General Discussion

My son and his GF on a road trip in Indiana he said cruse was set at 60ph

And out of no where almost lost control of his suv

Some jack wagon must have been flying low rear ended them .lucky no one was hurt

The guy inthe truck took off my son things he was trying to get away but so much damage it dumped all atf and antifreeze . Guessing no fluid no moving

LEO show up take all the info ask the guy he said yes I do have insurance with progressive even gave the cop a his insurance ID number

My son said him and the LEO had doubts sure enough no insurance the guy lied about it all

My son contacted his insurance company and also the police department that made out the report and were lied too

Today my son got a couple estimates

Just short 20k to repair his Honda

I and he also going to push to just total it if the insurance company wants to repair it

With that much damage it may never be right and any hope to sell it will take a huge hit over such major crash if any interest at all dow the road

Honest I was not suprized the fellow had no insurance as it's becoming way to common

Just got the ball rolling rolling today

So see how it goes

With 7 million illegals driving around soon, this will get more and more common. Thanks J o e

To my mind it is wholly irresponsible to go out into the world incapable of preventing violence, injury, crime, and death. How feeble is the mindset to accept defenselessness, how cheap, how cowardly, how pathetic. Ted Nugent.

Happened to my wife a few years ago D-R. On her way home in Speedway, IN at 1:00 AM (she is a nurse) and 3 punks turned left in front of her. They jumped out and ran. Police found them close by hiding behind some bushes. They claimed that they didn't speak English so the police asked for a officer that spoke Spanish. They went to the station and claimed that it was their bosses car and was insured. They were let go and told to come to court in a couple of days??? Never showed, no insurance, wife in the hospital for 3 days and off work for 2 months. Yes, this will get more common.

It's too late for me, save yourself.

Hope your son and GF are okay.

It is getting pretty crazy out there these days. This sounds like what happened to us in September, 2019 and the guy was charged and still has not gone to trial.

Driving home on a Sunday just getting ready to make a left turn at a lite four way intersection and a guy comes flying down my side of the road no where for me to go we get hit head on. Totaled my wife’s Lexus and cops said we were lucky to be alive as they estimated his speed at almost 60 mph.

Come to find out guy was drunk he passed on off duty cop on double yellow line. After cop called in his plate and while cops were looking for him he hit a lady standing at a cross walk and that was what he was fleeing from.

After he hit us he fled the scene, swam across a river and mooned the cops chasing him. The cops put a dog on other side of river but did not find him. They knew who he was so turned himself in next day.

He was charged with 12 serious driving violations.

He still has not given me to trial for the charges. We just got another letter from court Victim Advocate the guy is having another pre trial hearing on 2/24.

yep glad to hear everyone was allright, My son had someone cross over the median on the interstate and hit him head on in his new honda, it was less 2 months old. after a long fight with the insurance of the other guy he still lost about a $1,000 on the car, but I told him I know its not right but his life and the friend he had with him were worth more than that and that new car had saved their lives with the front and side air bags and other safety features. Hope all turns out well for your son and GF

Had a guy pull out in front of us on a two-lane highway. Trooper came and we both gave him our Kentucky insurance cards (we both had Farm Bureau coverage), etc. etc. and all was well. No injuries, fairly minor damage to our Grand Caravan.

A few days go by and insurance company calls us. Seems jerk had canceled his insurance as soon as he got the proof of insurance card. I called the trooper and he knew the guy. Trooper was not surprised and a bit peeved so I think things got taken care of😁

Insurance fixed our van and we were fine.

My son called the local cops who handled the accident as soon as he found out the guy lied about insurance

He thinks the locals may go after the guy now for trying to leave the scene and giving false info to the police as starters

    20K is a lot.

What year and kind of car was it?

  • OakieOakie Member Posts: 40,510 ✭✭✭✭

Like I told my son when his truck got totaled, I can replace the truck, I can't replace you and your buddy. He got hit head on by a drunk driver, with no insurance. The drunk driver, ended up being a friend of mine from HS. Nobody got hurt and my insurance paid for the truck. My HS friend wasn't charged with DUI, because she left the scene and came back 30 minutes later and turned herself in. She got a wreckless driving ticket.

its a 2022 Honda CRV I think he said he paid 31 or 32k for it new so really a year old the repair est was 18K+ I just rounded off to 20K we really think it will be totaled even the body shop told him that ( their well know and respected shop by customers and per the insurance company )

my concern since its his insurance company going to pony up the money and not the fellow who hit him they may buck at it being totaled

but 18 to 20 K not counting a rental car and found damage once its stripped down to repair on a 30k car is crazy

add in the body shop worker told him they have a Honda ready to go now for 6 months but waiting on the air bag sensor ? against the law to release it with out the part installed so its just waiting they just can not get parts .so I will waged storage fees will come into play

the est repair cost has to go beyond the repair replace % insurance company's us I also suggest he remind them the resale value of the car will be crap if they do repair it as it will follow the car in the form of major repair on car on car fax and similar reports

, I k think the insurance company may also go after the guy as they do some times

  • Ditch-RunnerDitch-Runner Member Posts: 25,238 ✭✭✭✭

today my son learned the guy may have insurance, but the insurance company called him asking a ton of questions trying to blame him it sounds like a lot of finger pointing and facts not right

a ton more info but dont want to share a lot on a public forum.

he is considering getting a lawyer is bottom line for now

  • ROY222ROY222 Member Posts: 548 ✭✭✭

I would recommend them both go to a Dr. for a checkup.

Sounds like a pretty serious impact from the back. Hopefully they are still young and don't break as easily as us old people.

When my Daughter was going to college in Muncie, I was over there every week to see her and to conduct business. I saw so many fools doing REALLY STUPID stuff on the highways. My cheeks were always clenched on the road there.

I told him the exact thing injured can take weeks to show up if not great but having a record of going in will go a long way if problems show up

It sounds like the interesting deputy filed a report ad no fault to stay out of any insurance issues and possibly y son had slowed down causing the wreck as he did not see it happen just his thoughts

My son is also calling the sheriff over the depilutry trying to avoid being part ot the insurance battle

My son is fit to be tied over the wall their putting up

Will add a short version story One of his close co working buddies some yrs back faced a similar fight

he went to a lawyer said look I need 80k to cover my losses add what ever you want just get money back

The lawyer added his pstr in the to the suit the insurance company lost and had to pay 160k thanks to forcing the fellow to lawyer up to go after them

  • Ditch-RunnerDitch-Runner Member Posts: 25,238 ✭✭✭✭

    too funny

now the guy changing up the story again he is saying my son had stopped in the raod waited on him and went into reverse as fast as he could and hit him

    OMG just amazing

Glad they are OK. Sounds like they are going need a lawyer to get this settled. A shame.

Not so funny! Just about every rear end accident around here get blamed and ticketed to the vehicle that does the rear ending. I sure hope your son makes out well without having to spend an arm and a leg! Also recommend both he and his girl friend counter sue that idiot driver with whiplash claims!

Never been one to escalate a thing that should be so cut and dried but what I see happening is pure evil greedy intent here.

I was once told by a senior LEO: If you interview someone immediately after an accident, he is likely to tell you the truth about the cause. But, once he gets a chance to calm down, & discuss all the different ways the accident could have happened, the story changes. ....and, it keeps changing.

If an accident is the fault of the other guy, you really want to get the police to write a report.

First, I hope your son and his GF are doing ok.

Second, the computers on both cars can be downloaded and see exactly what they were doing at the time of the accident.

Third, in any state that I am aware of the laws, if you hit another vehicle from behind you are at fault for following to closely.

Last I talked with my son he was going to call a lawyer on his next day off which is tody i think find out where it goes from their

Sad it has come to this but more common every day

the law firm is some what local law firm that's well know also basic ambulanc chasers but what ev we it takes

when we had cable they were on the local channes big time Foshing for clients

but seem they get results and huge settlements for there clients And line their pockets of course

I did tell my son for him and hid gf no matter how they feel even fine right now go to a local hospital get some checks at least it will be documented if something comes up

Thanks all for the support and suggestions

I did not intend to make a mistake I series

@Ditch-Runner Look at the damage to the other vehicle. IF he hit the brakes, the front end would dip & the damage would be higher up. This wouldn't happen in your son reversed.

  • Ditch-RunnerDitch-Runner Member Posts: 25,238 ✭✭✭✭

thanks I sure they come into play

when My son and his GF were hit the guy in the pick up truck took off so my son chased them until the guys truck just ran out of go power ( the photo I seen he had taken all the trans fluid and anti freeze were on the ground under the truck where all the radiator and coolers were destroyed and the guy drove until it quit .

my son took photos of the other guys truck and his after they stopped , he is also requesting any film the deputy's dash camera captured on his arrival. to the scene

    as far as taking photos

a bit of info not related but maybe a little my oldest son a amateur photographer and has a lot of nice cameras and related items ( he is worried the impact could have hurt some of the , he keeps with him any time he is traveling he is big time RR fan he takes hundreds if not thousands of photos on 35mm slide film every year .

sounds like my sons insurance company is taking the lead roll and working with him in scrapping or reaping his vehicle the other guy had some bare min coverage that law allowed to say he had insurance 😣 which was not even in the ball park enough to cover the damage

last update to any one following along or offering advice.

thank =s for the support and thoughts

today my son got a call ( his insurance company ) they are totaling the Honda as no way to ensure the drive train did not receive some hidden damage that will affect it down the road at some point from the crash

I know he had been talking to the Honda dealer and they tell him to expect a wait 3 or 4 weeks on another one .

Insurance is such a pain to deal with......they will pay him what they decide the car was "worth" but it might not actually pay for the car because payoff might be more than what they give him. That is what "gap" insurance is for. Which is ridiculous. If you are insured it should just be that......not insured, but you need other types of insurance to be REALLY insured. So, to be certain he is made whole in the end I'm betting he will still need to get an attorney involved. If they are fighting taking responsibility it will be worth it in the end to sue the crap out of them .....their insurance company will end up making an offer before it goes too far, it will be less costly for them to do that than to follow it to the end.

he told me they are paying full market value which right now is good sounds like a break even with what he paid including taxes when he bought it

now getting a replacement is a bit different the dealer he bough his and his GF bought hers have been decent dealing with but do not have one and said maybe a 3 to 5 week wait ? but other dealers who have one on the lot are asking / getting 3 to 4k over the sticker price just not going to be him

he said the Honda dealer he has been using told him they do not gouge. people as at some point the demand will slow back down and people will remember they were treated fair selling them a car and will back as return customer.

I think the towing company is supposed to pick it up in the next few days
