Why the devil aren't we challenging the UnConstitutional crap congress keeps enacting by filing suit under the 10th Amendment?

    Henry,

    While I agree 100% that many of the laws passed by Congress are unconstitutional, fighting them in a court would prove to be futile. Why? Well, let me give you a recent example:

    D.C. vs. Heller

    While some may consider this a "victory" for RTKBA, it is just the opposite. Mr. Heller took on the goverment, claiming that the D.C. gun laws were unconstitutional, and of course, he was right; they are unconstitutional. What Mr. Heller failed to realize is that all three branches; the executive, legislative, and judicial, are all linked, and the corruption present in one permeates into the others. Hence, you have a decision handed down by the judicial that left the door wide open for the legislative to create more restrictions, which will be enforced by the executive.

    I agree there needs to be a restoration, but it will not occur in a courtroom.

    In a word, too much chance of losing. With four law-abiding justices on the Supreme Court (no other court matters, the pivotal issue will wind up with the Supremes), four scofflaw justices, and one weathervane who has no apparent legal compass, we can lose as many as we win... and those losses have a PERMANENT effect.

    If Presiden McCain makes a few appointments to replace the justices most likely to retire (Souter, Stevens, Ginsburg), THEN will be the time to start bringing those 10th amendment suits. But not now, sorry.

    Because most of the internet extremist zealots are all talk, no walk, and the rest know that they're wrong even though they refuse to let go of the fantasies.
