Man, she is a idiot...
Ove the phone i yelled at her and her new boyfriend she left me for and destroyed a 5 years marriage, forced to seel the house i worked so hard for, ect ,ect...

I was going to pick up a Mossberg 590 for home protection last night, and on the form they run before they sell it to you, there is a question.

"Do you have pending harrassment charges"...

Does this STOP me from buying a GUN?
if so how long?

You have go to be kidding me man....

Form 4 states and I quote- "Been convicted in any court of a misdemeanor crime of domestic violence? This includes any misdemeanor conviction involving the use or attempted use of physical force committed by a current or former spouse, parent, or guardian of the victim, or by a person with a similar relationship with the victim."
I don't think this would prohibit you from buying a gun, unless you were convicted. [:D]

"Molon Labe"; ancient Greek for "Come and get them".

To the brave men in that narrow pass so long ago, freedom was more important than anything; even their lives. May we ever remember that fact should we be issued the same degrading terms.

If she has an order of protection (restraining order) against you, you will be ineligible to purchase a firearm.

Here's a list of the form 4473 ineligibilites:

    - Those convicted of crimes punishable by imprisonment for over one
year, except state misdemeanors punishable by two years or less.
    - Fugitives from justice.
    - Unlawful users of certain depressant, narcotic, or stimulant
    drugs.
    - Those adjudicated as mental defectives or incompetents or those
    committed to any mental institution.
    - Illegal aliens.
    - Citizens who have renounced their citizenship.
    - Those persons dishonorably discharged from the Armed Forces.
    - Persons less than 18 years of age for the purchase of a shotgun
    or rifle.
    - Persons less than 21 years of age for the purchase of a firearm
that is other than a shotgun or rifle.
    - Persons subject to a court order that restrains such persons from
harassing, stalking, or threatening an intimate partner.
    - Persons convicted in any court of a misdemeanor crime of domestic
    violence

If you've not been convicted of anything and you don't have a restraining order against you, you should be able to purchase a firearm.

Very simple, see if you pass the Brady check, you'll find out PDQ.

Yeah but can't you get in trouble for just trying to buy a gun when you're technically ineligible? In other words, if he answers no to all the form 4473 ineligibility questions, then the dealer runs the check and it comes back ineligible, meaning that one or more of the questions on the 4473 should actually have been answered yes, can't he get in trouble for lying on the 4473?

Those orders of protection do expire or can be withdrawn.. Judges hate to dismiss these orders. They will never do it to aid someone in buying a gun for any reason. Never mention buying a gun to anyone but your licensed gun dealer.

Well, I asked her today is she would please re-consider she said that "i was going to have to take responsibility for my action".

    "True Hypocrisy in Action Folks"

"My wife lies for 1.5 years while she is having an affair with someone she meet at a church coffee shop...."

But I need to take responsibility for my actions.

Not only was I paying child support close to 2 years BEFORE we where divorced, I have given her more on several occasion.

"She has recorded" the phone call.

    So i lost my cool.

Bottom line....MOST People are HARDCORE HYPOCRITES.

Do as I SAY not as I DO.

anyway...I am going to Dispute them and I am not giving her one buffalo nickel over what I own her from now on.

Fight fire with fire. Put a restraining order on her and the boyfriend. Why should they be allowed to buy guns if you can't?

In Crapifornia, if you file or have filed against you a restraining order, you need to get someone to hold your guns until it is over.

So if you are under threat, the response is to disarm you.
