How is it legal to ship this pistol to a persons home? This is new to me.

He must have changed the description or you read it wrong cuz I don't see anywhere in the ad where he says the gun is being shipped to someones home. If you meant the adult signature thing-that is a UPS deal-the gun should be C&R eligable anyway and that would require a signature if going to that persons house.

The listing specifically says he will ship only to an FFL. But, just for conversation sake, doesn't federal law allow him to ship directly to a buyer IF that buyer is a resident of the same state as him? But, figure the odds. With 49 other states, the buyer will probably NOT be from his state.

Actually, it doesn't say that either.

"AUCTION IS FOR A COLT 1908 POCKET HAMMERLESS 25ACP SEMI AUTOMATIC PISTOL. SERIAL #218433 MADE IN 1910. I AM A FFL DEALER. NOT FOR SALE TO STATES OR AREAS WHERE ILLEGAL TO SHIP.ADD 3% FOR CREDIT CARD SALES. MICHIGAN SALES ADD TAX. ADD $3.00 IF SIGNITURE FOR DELIVERY IS REQUESTED. NOT FOR SALE TO ALASKA OR HAWAII. "

True. My mistake. I was looking at the part just above there and at the bottom of the page where it says:

Firearms may only be shipped to a licensed dealer (FFL Holder).

But the question still stands about the absolute truth of that statement if the buyer is a legal resident of the same state. At least here in NV, you can sell and ship directly to a private buyer, but ONLY if they are NV residents.

As for that, I believe it has to be a face to face sale, but I'm not sure.

The way I read it was that the item can only be shipped to a licensed gun dealer. And am I missing something or does the bidding not end until 10/05?

He changed it after I posted this. It originally said that "he was an FFL but that this would ship directly to your home". I had sent him an email this morning just being neighborly. He just emailed emailed and thanked me for catching his mistake. He said GB sent him an email this morning about it as well.

ANDREWSW16. An FFL may be able to ship to an individual in NV from NV but the individual would FIRST still have to go to that FFL to fill out the 4473 paperwork. That has to be done in person and called in when the person and the firearm are physically there.

What about a non FFL in NV selling to another non FFL in NV? Can it be shipped within the state? Or do they have to meet face to face?

Ah. I think that is the point. An FFL has to have face to face, but a private seller can sell and ship to a private buyer IN STATE. Too many fine points in our gun laws. Too many chances to step on your own ..ck.

Yep, I still had the window open, here is a C&P:
