buying guns online from an individual

I have paid for a gun that I got the winning bid on. It is sitting at my dealers now and has been for a few days. He (my dealer) says by Alabama law he cannot transfer the gun to me without information from the seller such as a copy of their drivers license, simply because he is not an ffl holder. Now I'm trying to get in touch with the seller and having a **** of a time doing it. Is this some stupid Alabama only law ? Is my dealer scared silly of the ATF and just feeding me bull? What is required of a non-licensed seller? Somebody fill me in please.Thanks,Mike

    I don't know Alabama law; but in South Carolina my understanding is that the law with pawnbrokers (whether dealing with firearms or not) is such that they are required to get appropriate identification from anyone they buy something from.Since your dealer is "legally" taking possession from the seller and you are "legally" taking possession from him, it would seem prudent for him to have some sort of reasonable record of where the firearm came from--even if not for "criminal law" purposes in your State, civil concerns would seem to make record keeping on such issues a prudent precaution.

    I don't know about Alabama law, but before I got my FFL I ALWAYS sent along a photocopy of my driver's license and CCW marked "For FFL Dealer's File Only!". It just seems like a good way to cover one's buttocks. Unless it was his first online transaction, your seller should have known to provide some ID along with the firearm for the dealer's transfer file. On the flip side, it always pays to ask your tranfering dealer ahead of time what his preferances are when taking Internet transactions through his shop. Even if there's no law prohibiting an "IDless" transfer, the dealer may not want to try it. Just food for thought.

    I think your dealer is afraid of the ATF. I live in La. and had the same problem. My dealer made a receipt from the info. on the return address on the box, got my background check and turned it over to me. If you'd like, I'll ask him exactly what it takes and get back to you tomorrow.

    Michael, My dealer says that in the case of a long gun, he can log in the info. from the address you used to purchase the gun, but would prefer an FFl transfer. I have been doing business with him a long time and he knows me well. He states that he is taking a chance in case of an audit in this case, but ATF is not nearly as stringent on rifles as pistols. In the case of a handgun he would require an FFl or copy of Dr. Lic. In my case it involved a rifle and he felt comfortable doing it the way he did.[This message has been edited by oneshy (edited 11-06-2001).]

    I live in Alabama (also have FFL) and am not aware of any law requiring DL copy to inventory gun. He can list name and address of the person who sent you the gun. I am sure he has a return address too from the box. He is only acting as a go between and he needs only to note that it was a private sale and you were the intended buyer.I think he is a bit over on the side of caution, which is not bad. I do the same for ID purposes and if the weapon might some how show up as stolen.

    I live in Shelby Co. but base our business out of Montgomery. If you were at the local Montgomery Gun Show this past weekend you would have seen me...not hard to spot at 6'4" 225lbs.

    LOL - Lowrider - Football was my first love, however; I found females to be much more fun. All I can do now is pull for BAMA and wish I had my youth back. Used to play Defensive End but today could only be a small linebacker.
