    The prosecution for this is out of line with the offense.

    Burning any flag or banner or standard is now considered an act of free speech. The charges that could/should be brought are theft (if what is said is true that he took it from someones porch) and destruction of private property. Minor offense with a fine.

    Along this line of thinking, if someone were to steal my Stars and Bars or Bonnie Blue or Gadsden flag...can I then have them charged with a hate crime as those seem to be associated mostly with white societal elements?
