.... bite my neighbor and I could be prouder of her.


I have been having problems with my neighbors cat coming over spraying the steps by my back door. I talked to him about it and he said it was not his cat and just a stray he fed. I caught the cat in a hav-a-heart trap last night and brought to the shelter this morning. The vet was there and they wanted to neuter the cat if it was a stray. I told them my neighbor left food out for it but it was a stray so they could do what they wanted with it.


I was working in my garage and my neighbor walked in and wanted to know if I had seen the cat. I told him what I did and let him know he could leave. He got upset and said I had no right to do that to his cat. I reminded him that as the animal control officer it is my job to take care of stray cats and that is what I did. he started coming towards me and my dog bite on the leg and arm. He took off hollering and swearing. I called to sheriff and let him know what happened in case the guy tried to press charges. The sheriff said if I didn't invite him in he can be charged with trespassing and my dog was doing what good dogs do.

    I like it that your neighbor looks after a stray cat.
    He should, however, have no qualms about a stray being neutered.

    Looks like your dog was doing a good job.

    Just me but I would have to thank you for having it Spayed.

    Feeding one right now, that is taking its time getting used to me. Just had to chase another off tonight that just showed up. And if that Big Persian shows back up that was here this weekend, I'm staying in the house. Man was it ever big.

    I can't believe he wouldn't be really grateful. Unless he's too stupid to realize the damage an unneutered male cat is doing to his stuff as well as yours.

    In general, a trespasser is someone who wasn't invited on the property. Unless you warn people off your property with signs or locked gates, you are considered to have given an "implied invitation" to members of the public to approach your door on common errands - for example, to speak with you, try to sell you something, or ask directions.

    There was a visiting or stray tom cat who would come in our garage and mark his territory, even though it was not his, and he would pick fights with our ex-tom cat, and eat his food. [:(!]

    We caught the visitor and took him to the vet for a trim. When we brought him home, we gave him food and water. He ate and drank, and then disappeared, and we haven't seen him since. I reckon that was $80 well spent! [:D]

    If he was a visitor and not a stray, and he went back home as I figure he did, the lack of testicles may keep him there. Or, he may just stay away from here, figuring we will cut off something else if he comes back. I haven't heard any complaints from any neighbors about their cat being neutered without their consent. [;)]

    I'd be extremely vigilant for the next few weeks or months. A dog is very easy to poison unless aggressively taught not to take food that you don't hand him. A small chunk of London Broil, syringe laced with a little antifreeze and tossed onto your property is all it takes...and your neighbor sounds like he's just the type who would do that.

    If he sues I'd sue right back for damages suffered from "his" cat (which he laid claim to). Paining your dog's teeth with his dumb * limbs and emotional distressing your dogs delicate mental health.

    Had a neighbors dog that kept coming over and pizzin' through the patio door screen. Neighbor thought it was funny as all hell when I told him to keep his dog at home.
    As luck would have it the screen was steel, so I hooked a fence charger up to it and put another peice of screen down for a ground pad.
    Don't know if it would work for cats, but it sure works for dogs.

    I heard about a guy in a similar situation who tried very hard to talk to the neighbor about a bothersome cat. Went on for a year or so. The animal control people were involved and still the cat came over and sprayed this guys porch.

    Finally the homeowner walks out and 22s the cat, blammo. picks up the remains and tosses it over the fence into the former cat owner's yard.

    The cat guy sued the cat shooter for emotionally traumatizing his wife....(she found the former cat)

    I never heard the outcome

    What State do you live in? What Law School did you graduate from?

    I live in New Orleans, Louisiana, and I live in a neighborhood. Once you walk off of the public sidewalk (and to be exact,20" for the City's servitude),you are on "Private Property", and the homeowner can request that you vacate his property immediately.
    If you think the private property laws are tough, the gun laws are very simple. Your refusal to leave,is easily interpreted as aggression. Now you are open game!
    We also have "The Burglar Law" and "The Car Jacker Law"...two more easy kills!

    In short, * strangers are not welcome down South!

    Earl - I am not your biggest fan. Sometimes what you say (post)makes me feel a little apologetic for the image you present of Sountern folks.

    That said I want to recognize and support your love and advocacy of a way of life, a thought process, the way we think about some things. Being Southern is hard to explain. Simply put: I know I am and I am good with it.

    There is a book that I used to give to my friends from other places to help explain it: Book is called "SOUTHERN IS" written by Mary Norton Kratt. For all I know this woman could be from Exit 163 in New Jersey but she hits the nail on the head right often.

    Heck no Earl, you haven't so much hurt my feelings as I am worried that folks that don't understand you will think you are too radical to be taken seriously. We stand a little apart on the race thing but after 49 years of swimming in the pool of racial angst I have just had enough :) No Sir, you are a pretty sharp cat here in the forums (or "fora" as we have recently learned is the correct wording) and I just hope you are understood.

    So many folks that I have met and known have formed an opinion of me and my background based on whatever someone has told them about the South and it's people. I have an accent that you can't believe and most pople take me to be slow witted just because I am slow talking.

    If you had offended me I'da told you. It isn't in me to sit still if I get mad.

    To me it's an interesting legal question. On one hand, you had the right to remove the cat from your property. Even kill it. However, did you have the right to have it fixed? If the neighbor was feeding it, even if not 'his' he had assumed defacto ownership of it. Kind of like, "The neighbor keeps parking his car over my property line." You have the right to call a tow truck, or push it back over his property; but you don't have the right to slash his tires or blow it up.

    I'm not saying that what you did was wrong; in fact I think that it was quite just given the circumstances. If he wants his cat, let him go down to the shelter and pick it up.

    However, let's put the shoe on the other foot. Not that I would suggest that you would let your dog roam, but if he DID regularly get out and crapped on the neighbor's lawn regularly, and the neighbor took your dog in and had some surgery performed on him, how would you feel?

    I'd have given him one more warning: the cat pisses on my steps again, it's going in to get fixed.

    THEN I'd have done what you did.

    A little cat piss is irritating at most. However, a pissed off neighbor is trouble waiting to happen. You escalated a conflict- however justly. I hope you don't suffer for it. As said- watch your dog carefully. If your neighbor is the vindictive type, he might retaliate.
