Davidians Appeal Wrongful-Death Case

NEW ORLEANS (AP) - Branch Davidians and their families have appealed the dismissal of their $675 million wrongful death lawsuit over the 1993 federal assault on the sect's Waco compound.


Attorneys for the plaintiffs accused U.S. District Judge Walter Smith of bias against the Branch Davidians and their leader, David Koresh.

Koresh was among some 80 men, women and children killed after the Davidians' complex burned to the ground April 19, 1993, after an armored federal assault. The assault capped a 51-day siege that began with a raid by federal agents that killed four agents and six Davidians.

Smith dismissed the lawsuit in 2000, agreeing with an advisory jury that concluded the government was not responsible for the deaths.

In a 125-page brief filed Monday with the 5th U.S. Circuit Court of Appeals (news - web sites) in New Orleans, the plaintiffs say Smith was involved in the initial raid from its planning stages and he manipulated and excluded evidence.

Smith did not return a call seeking comment Thursday.

    the Davidians have to take a small part of the blame for their deaths but I have to say that the government sure in the hell has to take the largest part

    I don't know about that, since when do, children have control over what government agents do, or what their parents decide to do.

    If these allegations are true, this Judge ought to be removed from the bench.

    I'm curious to know, if the question has been raised concerning the use of military weapons used by these agencyies against citizens is legal, especially the tank that caused the disasterous fire.

    I know the Army is prevented from using it's arsenal against citizens, without the president invoking a state of emergency.

    Afterall, the law preventing the use of military weapons by federal troops was focused on the weapon and not the individual using them.

    The ATF, FBI, Local law enforcement agencies, in this case I'm sure were outfitted with military issue equipment.

    It was only recently that certain agencies were trying to make civilians distroy any military issued equipment in private hands.

    If they did, It makes sense this would include military issue equipment in the hands of local police agency's.

    How about in the hands of the state militias??

    Is ther anybody anywhere that can identify "who their state Militia is??

    The posse comontatis(sp) act was taken off the books like 10-15 yrs ago.
    They can use any means they see fit now.

    we are not free from attack by our own military at all now.

    Just to be clear, Delta Force planted the explosives that contributed to the fire.

    'Course, the several dozen tear gas grenades didn't hurt either.

    The cement bunker that the women and children were hiding in, seperate from the main house was specifically targeted in the hopes that gassing and blowing up their wives and kids would make the men give up. Just like the psyops the Feds used on Weaver in Idaho.

    After they blew his wife's head off, they got on the megaphone saying stuff like:

    "Mrs. Weaver?! Whatcha gonna make us for breakfast Mrs. Weaver? We're having panackaes! What are you making!?"

    Also, killed ain't what happened. It's called murder.
