I have a buyer of a model 12 that wants a refund. He claims the gun was misrepresented. I answered his questions and had pictures and the description was accurate in my eyes. I am not a dealer what should I do?

Make sure he is specific in how he feels it was misrepresented. He may think "very good" means "like new" etc. If he will be specific you can figure out if he's just being a problem and wanting out of a deal or if there is a genuine misunderstanding. Then you can find a seller that appreciates the gun.

I say honor his request for the good of the big picture. You'll get a credit with GUNBROKER for the fees. He'll be out his expenses ie: shipping, etc which will be substantial $75-100. This whole internet auction thing is predicated upon two basis. First is plain honesty and blind trust. A buyer has to buy a pig in a poke, sending large amounts of money to some unknown entity that may or may not even be real. Second is that buyers may not agree nor be satisfied with a TOTALLY SUBJECTIVE condition rating. When that individual trusted you with his money sight unseen you accepted that trust and responsibility. I have so far been very impressed with the integrity of the people that I have completed transactions with. BUT and a very big BUT, I have so far found about 10% of gun dealers both here and in person to be total jerks. Extremely rude, unprofessional and just plain nasty. The other 90% are an absolute pleasure to meet. For the good of the sport, take the high road.

This is why full disclosure on every auction item is so important. I'm not saying you didn't do it, but this is why it's important to mention every issue with every auction item. Every buyer who knows precisely what he's buying will, or should, be a happy buyer.I would be interested in knowing more about the misrepresentation, or misunderstanding, and whether it has merit. Do not offer to pay his end of the return fees -- after all, he shares some responsibility -- and your FFLer will probably want something additional to receive the gun back, but if you talk to him maybe not much. You can certainly say, hey, I'm not a dealer, you saw the pictures, no refund, and about all that will happen is one negative feedback, unless you've committed a real fraud, which I doubt. I do suggest that if you are selling at auction and are using the money to pay bills, that you definitely put a "No refunds, please ask questions and examine photos closely before bidding" disclaimer on all your auctions. That should save you any awkwardness later, short of fraud. And again, be sure your descriptions are complete. We sellers have gotten so much into drafting our "policy statements" that some of us forget that an auction requires a complete item description. I saw an auction yesterday where the seller neglected to mention something basic -- the caliber of the gun. Mention nicks, cracks, bluing, pitting, loose or incorrectly operating parts -- everything. My photos have gotten a lot better over the last couple of years, and that has helped tremendously. I get more and higher bids, and happy customers without exception so far.

Again I ask, what was the nature of the problem, and what is the item number of the auction? I'm curious.

Thanks for everyones comments. I am taking the high road and will give the guy a refund. His supposedly model 12 collector freind told him the gun was a piece of junk and so I think maybe if that is true then he got embarresed and need to blow off at me. The problem was that I told him that the gun was not a reblue. I have never seen a true reblued gun with scratches and pitting like this gun had, which I described in detail to him via E-mail. So his advisor must have embarresed him. Whatever he was a one time buyer so maybe he will stick to buying siomething he can put his hands on with his collector freind. Discussion is settled and thanks to all of you.

It sounds to me like buyers remorse but you are to be applauded for your action. I'd give you an A+ for your efforts. On a less positive note remember "i before e except after c" friend.

dakotashooter2: "i before e except after c" -- are you weird or something? Do we have the leisure to debate this? Being a little fussy -- or just feisty? Deifying rules that are often broken? Will you reive the spontaneity of our discussion? Create seismic waves out of miniscule errors? Seize upon every slip? Or am I just full of heifer dust?

Sorry guys I am a bad speller. My wife is a school teacher and corrects me all the time, but she was a work when I posted my remarks. I really need spell check on everything that I type and send out on this computer. I think I got my point over even if I didn't misspell a word or two or however many.
