MOTHER OF WENDY'S SLAY VICTIM SUES GUNMAKER

May 24, 2002 -- The mother of a Queens woman killed in the Wendy's massacre has filed a federal lawsuit against the manufacturers and sellers of the gun that killed her daughter - as relatives of the victims mark the two-year anniversary of the shootings today.
The negligence complaint, filed on behalf of Joan Truman Smith in Brooklyn federal court Wednesday, holds Bryco Arms-B.L. Jennings and its distributors responsible for the death of Anita Smith, who was killed along with her four co-workers in the May 24, 2000, slaughter.

The Bryco-Jennings .380 used by accused killer John Taylor and confessed accomplice Craig Godineaux was a "public danger and public nuisance" because the manufacturer intentionally sold it as a "crime gun" into an underground and illegal market of weapons sellers, the complaint alleges.

The complaint - which traces the twisted trail of Taylor's gun from a California plant to the streets of Queens via Nevada and Ohio - charges that the companies engaged in negligent marketing and distribution by flooding the market with cheap guns they knew would end up in the hands of New York criminals.
