OK, so flip the arrangement....some dude walks into a cops apartment on accident and shoots the cop. Is that manslaughter?

If their investigation fails to uncover any connection between these two, and it was in fact her negligence that led to the shooting then it would fall under manslaughter. It's still early, charges can be upgraded if the investigation uncovers something more nefarious.

Shilo - I think we may differ on the term reckless. In my opinion, It isn't reckless if you point a gun at the intended target and pull the trigger and kill what you intended to kill....

I would think a 3rd or even 2nd degree murder charge would be more appropriate, but then I wasn't there, and my internet prosecutors license expired on Tuesday.

Goes home...multi level apt complex.
Gets off on wrong floor...her apt is one floor down
same location.
Since the door key is different
the officer is having trouble with the door/lock.
DOA swings open the door in his underwear.
Bang.
Officer has co-operated completely with the investigation.
Bad JU-JU all around.
No boyfriend/lover BS involved.
That is the current story anyway.

Recklessness and negligence are different...if her story in fact turns out to be accurate, at the time she shot him she thought she was in her apt, and that he was an intruder...she was negligent in not being aware of where she was at the time, as in confusing which apt she was in fact in. Reckless is intentional indifference (utterly unconcerned) such as hitting a pedestrian while driving 100 mph in a residential area. If it is accurate that her * was in the wrong apt thinking it was hers, she didn't enter it to kill someone, she entered it thinking it was her apt.
