Holy crap!

http://www.fox4news.com/news/dallas-officer-goes-home-to-wrong-apartment-kills-man-inside

Off duty officer comes home, goes into wrong apartment, finds a man there, and kills him.

Drunk? Felony stupid? Affirmative Action poster child?

Wow. It may be as simple as the article states. She just went into the wrong apartment by mistake and things went south.

It wouldn't be a big surprise if more comes out of the story, as in she knew him and things went south when she stopped by.

    My thoughts as well.

Did she show up a little too early, by chance?

There's got to be more to the story.
    What's next?

Unless she is hopelessly and certifiably insane her story stinks to high heaven. Even if you buy the mistake about where she lived, how does she explain her key fit the lock and once inside she didn?t notice all her belongings had been removed and replaced with somebody else?s stuff.

Reminds me of the weird comedian that said somebody took everything out of his house and replaced everything with exact duplicates.

Yeah, this could be a career ender, but it?s Dallas so maybe not.

This may compromise future promotional opportunities.

"Dallas police said Friday they are seeking a warrant for manslaughter against one of their own after an off-duty officer entered the wrong apartment in her building and killed a man who was inside."

Manslaughter? Is that the best they can do? An innocent man died in his own home because she entered? Manslaughter?

OK, so flip the arrangement....some dude walks into a cops apartment on accident and shoots the cop. Is that manslaughter?

It is a fishy story. It was not only the wrong apartment it was the wrong building. Good idea, did she go to her boyfriend's place and find him with another gal?

If the story is true she had to be drunk or stoned.

I heard an interview with the mother of the deceased, they are black.
And she asked "If she encountered a white man there would he still be alive? Did she kill my son because he is black?"

You have to show intent for murder. If their investigation fails to uncover any connection between these two, and it was in fact her negligence that led to the shooting then it would fall under manslaughter. It's still early, charges can be upgraded if the investigation uncovers something more nefarious.

Sec. 19.04. MANSLAUGHTER. (a) A person commits an offense if he recklessly causes the death of an individual.

    (b) An offense under this section is a felony of the second degree.

Shilo - I think we may differ on the term reckless. In my opinion, It isn't reckless if you point a gun at the intended target and pull the trigger and kill what you intended to kill....

I would think a 3rd or even 2nd degree murder charge would be more appropriate, but then I wasn't there, and my internet prosecutors license expired on Tuesday.

    The current slant:
Officer worked a 14 hour shift.
    Goes home...multi level apt complex.
Gets off on wrong floor...her apt is one floor down
    same location.
Since the door key is different
the officer is having trouble with the door/lock.
DOA swings open the door in his underwear.

    Bang.

Officer has co-operated completely with the investigation.
    Bad JU-JU all around.
    No boyfriend/lover BS involved.
That is the current story anyway.

Someone is sharing a picture around on facebook purporting to be the suspect and victim next to each other, arms around one another with another couple. I'm not going to publish it because I have no idea if it is real. If true, might be problematic.

Recklessness and negligence are different...if her story in fact turns out to be accurate, at the time she shot him she thought she was in her apt, and that he was an intruder...she was negligent in not being aware of where she was at the time, as in confusing which apt she was in fact in. Reckless is intentional indifference (utterly unconcerned) such as hitting a pedestrian while driving 100 mph in a residential area. If it is accurate that her * was in the wrong apt thinking it was hers, she didn't enter it to kill someone, she entered it thinking it was her apt.

When she gets to prison she will have an escort to show her which steel door to get behind and she will only be allowed to have homemade primitive weapons.
