Defense Fund

CAC was founded in 1989 to fight government corruption by ousting legislators who dishonor their oath to defend the U.S. and California constitutions. CAC organized a landmark 1994 campaign, the state's first legislative recall to qualify in 80 years (after 114 unsuccessful attempts since 1914). CAC's recall against California Senate President David Roberti achieved its stated minimum objectives of emptying his campaign warchest, destroying his fundraising ability, and driving him from elected office. The CAC Defense Fund was founded to defend persecuted corruption fighters, starting with CAC officers who were hit with the largest campaign finance disclosure fine in U.S. history after the recall. The draconian fine was issued in absentia, in a Kangaroo Hearing of California's "Fair" Political Practices Commission, without jurisdiction under the state's Political Reform Act. Upheld by summary judgment without trial by jury or judge, the fine contradicts Supreme Court decisions on the relationship between forced disclosure and the 1st Amendment right to anonymous political expression under conditions of harassment, the 8th Amendment ban on excessive fines, and other Constitutional rights and human rights.
