Man fired at neighbor 'coming after him'
911 operator heard sound of door being kicked in

Sara Leaming
Staff writer

A Spokane man told 911 operators Wednesday that a neighbor was "coming after him" when he shot him to death, police said.

Clem L. Roberts, 45, was shot outside a second-floor apartment in the Saranac Apartments at 251/2 W. Main. Police said the man who shot him was on the phone with 911 operators at the time, and said he was afraid of Roberts.

"I just shot him," the man said just after the 911 operator heard the door kicked in and the sound of gunfire, police said.

The man, Carl E. Heerwagen, 40, was interviewed Wednesday night and released. He has not been charged.

Roberts was also a tenant at the Saranac, but lived on the third floor.

Heerwagen called 911 shortly before the shooting at about 6:30 p.m. The 911 operator heard yelling and what sounded like the man's door being kicked in.

Heerwagen told the operator he was afraid of the other tenant, later identified as Roberts.

Officers arrived at the 73-unit building after the shooting, and found Roberts lying in the hallway outside Heerwagen's apartment. Roberts died at the scene from a single bullet to the chest, an autopsy showed.

Police took Heerwagen in for questioning without incident, but later released him after major crimes detectives interviewed him and verified the account of Roberts' forced entry with 911 operators, police said.

Heerwagen declined to comment Thursday from the Union Gospel Mission, where he is staying.

Police recovered a weapon at the shooting scene, but it was not known if it was the handgun used in the shooting.

Police said Roberts has had several incidents involving assaults, and was considered a "caution" person for officers.

Court records show Roberts was acquitted of a first-degree assault charge in 1996, and had a lesser assault charge dismissed in 1993 http://www.spokesmanreview.com/news-story.asp?date=061402&ID=s1166797

Clerk detains suspect in attempted robbery

DESERT HOT SPRINGS -- A clerk armed with a gun and a stick detained a man who allegedly tried to rob a convenience store Thursday, the Desert Hot Springs Police Department reported.

David Ruble, 28, of Desert Hot Springs was booked into the Palm Springs City Jail on suspicion of attempted robbery and parole violations, police said.

The attempted robbery happened about 3:20 a.m. when a man walked into the 7-Eleven convenience store in the 66-500 block of Eighth Street and demanded lottery scratch-off tickets and money from the clerk, police said.

The clerk refused and told the suspect he would be shot if he left the store before officers arrived, police said.

Officers arrived within minutes and took the suspect into custody.

Police: 75-year-old defends car with gun

A 75-year-old man fired two shots at a woman in a northwest Gainesville parking lot Friday after the woman apparently tried to steal his car, police said.

The woman approached William Joseph Hunt of Gainesville at about 9 p.m. in the parking lot in front of Albertson's grocery store at 2323 NW 13th St., said Gainesville Police Department Lt. S.A. Scott.

Witnesses told police they initially thought the woman was a man because of her large size.

She implied she had a weapon and said if Hunt didn't give her his car keys, she would shoot him, Hunt told police. Hunt then pulled out a gun and fired at least two shots. He didn't hit her but some fragments scraped her leg, police said. Hunt suffered an injury to his hand during the incident and was treated as the scene.

Police caught the woman, but hadn't charged her by 10 p.m., and thought she might be a juvenile. Hunt probably won't be charged with anything, Scott said. He had a concealed weapons permit."According to all the information we have, everything sounds justified," Scott said.

Man Dies in Calif. Workplace Rampage

SAN DIMAS, Calif.- An ex-employee of a plastics business stabbed two former co-workers and set three others on fire by throwing chemicals at them before he was shot to death by deputies, authorities said.

The five workers were hospitalized, and six deputies suffered minor injuries.

No motive had been established for the rampage Friday afternoon at Maxdem Inc., which makes super-rigid plastic parts for automobiles and national defense.

The 30-year-old attacker's name was not released. Mayor Curt Morris told the Los Angeles Times that he was told the man had a Jordanian passport, received a doctorate in chemistry last year and had recently gotten engaged.

Witnesses told the Times they saw the man chasing workers. Richard Nassar said he saw the attacker throw a bottle of liquid that erupted in flames.

Nassar and his brother, Raymond, saw one Maxdem worker bleeding from a cut ear and yelling "Some guy's going crazy in there," Raymond Nassar said. "He started throwing chemicals down. Fire erupted."

Witnesses said the man was shot after he threatened deputies with a container or canister.

Firefighters extinguished two chemical fires inside the office after the shooting.

Los Angeles County Sheriff's Deputy Bill Spear said the two stabbing victims were in critical condition. Police said they didn't know the conditions of the burned workers.

The deputies were treated for exposure to chemical fumes and released.

Further proof that a person intent on killing another doesn't need a gun to do so. And of course, the California victims were helpless in the face of an attacker with a knife because they are forbidden to carry guns to protect themselves

    Driver Is Cleared
    In Death of Rider

he bus driver who fatally stabbed a knife-wielding passenger in Brooklyn last month will not be charged with a crime, authorities said yesterday.

A Brooklyn grand jury decided 33-year-old Clinton Phillip acted in self-defense, a spokesman for prosecutors said.

Witnesses said Christopher Bartley, 23, screamed at Phillip to drive faster, punched him and stabbed him in the back. As the two fought for control of the knife, Phillip stabbed Bartley in the heart in the May 5 fray in Brownsville.

Phillip was hailed as a hero for protecting himself and his passengers. His co-workers and his lawyer said he is still traumatized.

Years before, Phillip had run-ins with the law. He was put on probation for a 1991 weapons conviction, served about 18 months in prison for a 1992 chain snatching and was sentenced to three years probation in 2001 after hitting his daughter with a belt, authorities said.
