BATF Form 4473 'falsified' in firearms purchase leads to arrest

Two men charged for falsifying info in attempts to purchase firearms

SAYRE -- Dale Talada of 617 East Chestnut St. in Lancaster, Pa., was arraigned in district court on Aug. 12 for falsifying information while trying to purchase a rifle in the state of Pennsylvania.

According to police reports, on Nov. 29, 2001, Talada entered Solock Sporting Goods Store in Sayre and attempted to purchase a Mauser 8mm Model Yugo 48 rifle. To complete the purchase, Talada was required to file an ATF Form 4473 which is required by Pennsylvania Law.

Police said that Talada answered "No" to a question on the form which asks the question, "Have you been convicted in any court of a crime for which the judge could have imprisoned you for more than a year, even if the judge actually gave you a shorter sentence?" While investigating the matter, police said they found Talada had been convicted of six offenses in which he could have been sentenced to over one year.

Those charges include, but aren't limited to: four counts of retail theft, theft by unlawful taking, and criminal conspiracy to commit forgery.

Talada is being charged with one count of sale or transfer of firearms for his making a materially false statement in attempting the purchase a firearm.

Also arrested on similar charges of falsely completing form 4473 was Edwin Brown Jr. of RR 4 Box 4033, Dushore.

According to police reports, on June 20, 2001, Brown attempted to purchase a shotgun at Hafer's Gun Shop in Athens Township, where they allege he gave false information when completing the form.

During their investigation, police found that Brown had been previously in 1986 charged with two counts of indecent assault and two counts of corruption of minors. On June 23 after interviewing Brown at his home, police said that Brown never thought he did anything wrong, because his previous offenses had been so long ago.

Brown was subsequently arrested for one charge of the sale of transfer of firearms.
