FAA SEEKS COMMENTS ON ARMED PILOTSBy CAPTAIN DENNIS JACKSON Even though the Aviation Security Act of 2001 authorizes the use of lethal and less-than-lethal weapons by flight crews, the FAA needs the help of the flying public to put this law into effect. Section 128 of the Act provides a pilot engaged in intrastate air transportation is authorized to carry a firearm into his/her cockpit if-The Under Secretary of Transportation Security approves; (that would be former BATF director John Magaw) The air carrier approves; The firearm is approved by the Under Secretary; and The pilot has received proper training for the use of the firearm, as determined by the Under Secretary.The FAA is asking for written comments regarding firearms, less-than-lethal weapons, and emergency services on commercial flights. The agency is working to develop recommendations for possible future action by the Department of Transportation, and is seeking comments until february 14,2002.After receiving recommendations from the National Institute of Justice, the Secretary of Transportation may authorize members of a flight crew to be trained in proper use of a weapon and create guidelines for use of that weapon. Specifically, the FAA is interested in your thoughts about whether carriage of a weapon should be allowed on a voluntary basis and how the weapons should be transported to the aircraft and stored. The agency is even interested in your notion of exactly what the best weapon might be and what ammunition it should be capable of firing.The FAA is requesting guidance from the public on such other items as, should the weapons be stored on the aircraft or carried on board by a qualified pilot! (That's a no-brainer!) Comments on weapons-training requirements and currency are also welcome, as are your thoughts on what modifications to the aircraft systems -- ventilation, avionics, etc. -- would prove useful. The agency would also like to consider providing guidelines for when and how weapons may be used.
