Court Upholds Gun Lawsuit Dismissal11/20/2001 Email Print Subscribe The 3rd U.S. Circuit Court of Appeals upheld the dismissal of a lawsuit brought by Camden County, N.J., that accused gunmakers of creating a "public nuisance," the Legal Intelligencer reported Nov. 19."Whatever the precise scope of public-nuisance law in New Jersey may be, no New Jersey court has ever allowed a public-nuisance claim to proceed against manufacturers for lawful products that are lawfully placed in the stream of commerce," the three-judge panel ruled.The lawsuit claimed that gun manufacturers' marketing and distribution of handguns created and contributed to the criminal use of handguns in Camden County."To extend public-nuisance law to embrace the manufacture of handguns would be unprecedented under New Jersey state law and unprecedented nationwide for an appellate court," the court said.The lawsuit sought compensation for government costs associated with gun-related crimes. http://www.jointogether.org/gv/news/summaries/reader/0,2061,546550,00.html
