Newark's Litigation Against the Gun Industry Advances; Lawsuit Survives Motion to Dismiss To: National Desk Contact: Desmond Riley of The Educational Fund to Stop Gun Violence, 202-408-7560, ext. 104, or 202-262-9142 (cell) Web site: http://www.efsgv.org WASHINGTON, Dec. 12 /U.S. Newswire/ -- Yesterday, gun violence prevention advocates received good news as Newark, N.J.'s lawsuit against the gun industry survived the defendants' motion to dismiss. Although two of Newark's claims were dismissed, the remaining claims, including public nuisance, negligent marketing and distribution, and negligence survived. Now the litigation moves into the discovery phase, which will allow Newark's attorneys to probe the gun industry's business practices. Executive Director of the Educational Fund to Stop Gun Violence Joshua Horwitz praised the advancing litigation saying, "We only need one victory to bring greater accountability to the gun industry. Lawsuits against the gun industry are continuing and Newark represents a great chance for gun industry reform. This lawsuit seeks to force the gun industry to stop irresponsible practices that allow guns to flow to criminals. We believe that the discovery phase will shed light on gun industry business practices that result in the arming of criminals and young people." To date, a total of thirty-two municipalities and one state attorney general have filed twenty-three lawsuits against the firearms industry. Nine of these lawsuits have been dismissed, while ten lawsuits have survived or partially survived the initial threshold motions. Some municipalities that have had their lawsuits dismissed are also in the process of appealing their cases to a higher court.
