Appeals court throws out most of gun-violence suit






Gary lost another legal battle in its effort to hold gun manufacturers and dealers responsible for the city's violence.

A divided three-judge panel of the Indiana Court of Appeals on Friday upheld a lower court's dismissal of a critical part of the Gary's lawsuit -- but did revive one small part.

The city can pursue its public nuisance claim against three gun dealers for contributing to the "straw" purchase of a handgun -- when a customer buys a handgun and resells it or gives it to someone who can't legally obtain one.

Driver in deadly crash appears in court in bed

An Indianapolis man accused in a drunken-driving crash that killed a 25-year-old woman on Labor Day was wheeled into court Friday on a hospital bed.

Judge Grant Hawkins of Marion Superior Court released Kenneth S. Jacks Jr., who is paralyzed, without bond. He is scheduled to appear for a pretrial hearing Nov. 4.

Jacks, 22, is charged with nine felonies and a misdemeanor in connection with the crash that killed Olajumoke A. Lagunju of Nigeria and injured two others.

Jacks was released Friday from Wishard Memorial Hospital, and Hawkins ordered the defendant to live with family members.

Police said Jacks was driving his 1976 Oldsmobile north on Dr. Martin Luther King Jr. Street at about 70 mph when he lost control, crossed the center line and collided with an oncoming vehicle driven by Lagunju. The posted speed limit is 40 mph.

BOONE COUNTY

Panel begins addressing elementary redistricting

Zionsville -- A 22-member redistricting committee took the first steps this week toward changing school boundaries for up to 478 Zionsville Community Schools students.

Most of the students, in kindergarten through fifth grade, will move to Boone Meadow Elementary School when it opens next fall. The rest will move after the committee's reconfiguration of the current elementary school boundaries.

"We'll do the best we can to keep families together," said Bob Bostwick, Boone Meadow principal and chairman of the redistricting committee.

The committee's next meeting will be at 6:30 p.m. Tuesday at the Educational Services Center, 900 Mulberry St., Zionsville.

HAMILTON COUNTY

Lightning bolt starts fire in home; no one injured

Fishers -- A home struck by lightning early Friday caught fire after the bolt raced through phone lines and ductwork.

Deputy Fire Marshal Ron Lipps said the fire erupted in the attic of a two-story home in the 11100 block of Laurel Falls in the Spyglass Falls subdivision.

He said the lightning bolt hit the house, owned by Kyle Boyd, just after 7:30 a.m. No one was home, but a passer-by notified authorities.

Firefighters extinguished a small fire in the attic, but the damage occurred as lightning traveled through phone lines, electric wiring and ductwork. A damage estimate wasn't immediately available.

HENDRICKS COUNTY

Town won't give relief from huge water bills

Pittsboro -- Town officials have notified Brixton Place homeowners that they'll get no relief from huge water and sewer bills that started in June.

David E. Kenninger, a Danville attorney hired by residents, said he received a letter from the town saying officials had checked water meters and confirmed the water usage by about a half-dozen homeowners.

JOHNSON COUNTY

Petitions oppose location for a new high school

Franklin -- A grass-roots organization is circulating petitions in an attempt to block construction of an $85 million high school on the city's eastside.

About 50 people attended the Taxpayers United for Franklin Schools meeting Thursday.

"We're not saying we're opposed to a new high school, just the eastside site," organizer Tracy Mabry said.

Group members -- and two members of the School Board -- say the site at Eastview Drive and Upper Shelbyville Road is in a high-traffic area, sits amid future industrial and commercial growth and is not where the majority of students live.

MADISON COUNTY

Kids take control of car after mom blacks out

Pendleton -- Two young Madison County girls are unharmed after taking control of a vehicle on I-69.

Indiana State Police Cpl. Jeff Rader said 7-year-old twins Kristy and Kylee White of Pendleton took control of the car driven by their mother, Mona, on Thursday after she apparently blacked out from what police believe was a seizure.

"The girls were able to get up into the driver's area. They had the smarts to turn off the ignition, cutting power to the vehicle, and the smarts to steer the car so it would not go up into the other lane," Rader said.

The incident occurred around 4 p.m. in Hamilton County. Although the car ultimately struck a semitrailer truck, police said, only Mona White had minor injuries. The girls and their 2-year-old sister, Kelsey, were unhurt.

MORGAN COUNTY

County is among 74 in crop disaster declaration

Martinsville -- Morgan County is one of 74 Indiana counties included in a disaster declaration state officials submitted Thursday to the U.S. Department of Agriculture.

To qualify, a state must assess anticipated crop yields at least 30 percent below average in a county.

If the declaration is approved, farmers would be eligible for low-interest loans.

SHELBY COUNTY

Band boosters' account is short several thousand

Marietta -- Thousands of dollars are missing from the bank account of the Southwestern High School Band Boosters.

Auditors are reviewing the club's bank activity since 1999, and sheriff's detectives have been asked to investigate.

The shortage was uncovered when money was needed late this summer to pay for students to attend band camp.
