Carrying a loaded shotgun or rifle in Texas...

I know it's legal to do so, but before I do, I'd like to have a printed copy of the legal document (preferably from the DPS) that I can keep in the glove box.
Anyone know where I can find that info?

    Im from VA so Im not familiar with Texas State law.I would recommend you call your local Court House,or better Go there and xerox the Penal code or Ammendment stating it is legal.I can tell you Federal Law prohibits it on National Forest unless you have a Conceal Carry permit.     I know I could go to the court house and find such a document but that's what I'm trying to do here and save myself some trouble.

    I know FOR A FACT, in Texas, it is legal to carry a loaded shotgun or rifle in plain view I just can't remember where that document was.

    Seems to me that you are asking the question backwards. If it is not against the law, there will be NO document that says so. You will only find a document (law) if it is AGAINST the law.

    That said, you might want to look at the Texas State Rifle Association. Go to http://www.tsra.com/

    The Texas Penal Code doesn't state what you CAN carry, only what you CANNOT. In other words, you're not going to find anything that directly states you may carry a rifle or shotgun, instead it's a matter of what it doesn't say.

    The code states that you cannot carry an "illegal weapon" on or about your person (misdemeanor offense). This covers things such as handguns, clubs and certain knives. It defines a handgun as, "any firearm that is designed, made, or adapted to be fired with one hand".

    It also states that you cannot carry a "prohibited weapon" (felony offense). This covers items ranging from switchblade knives to brass knuckles. Included in this "prohibited weapon" category are short barreled rifles and shotguns.

    Any firearm that doesn't fit in either of these categories can be carried.

    Find yourself a copy of the Texas Penal Code at your local library or pull it up on-line and read Title 10. It covers all weapons related offense in the code. The sections I've referred to here are 46.02 (Unlawfully Carrying Weapons) and 46.05 (Prohibited Weapons).

    I wouldn't worry too much about being arrested for toting a legal firearm when all you had was a legal length shotgun or rifle. You're talking about a pretty basic issue that is dealt with regularly by most cops. If it comes right down to it, ask for their supervisor and he'll stop it from happening. He'll realize that your lawsuit over this will name him also!

    Seth you can walk around 610 loop with a rifle are shotgun. You may be asked a question about it, But you can do it.

    Txs beat me to the correct answer, and he is right as usual.

    One caution: Some CITIES may have further restrictions. The only one that I know about is Commerce, Texas. There, it is unlawful to carry that shotgun or rifle in you car with the CHAMBER loaded. You can load the magazine, but not the chamber.

    Nunn and Txs are correct.

    Didn't know about the Commerce thing. Used to spend a lot of time there some years ago.

    Besides, if it was illegal, then what would them good ol' boys do with the gun racks in the back of their pick-ups?

    Here in central Arizona everyone I know carries a loaded handgun in their glovebox or console and everywhere you drive to is in a National Forest.

    I'm starting to think the the Texas Chamber of Commerce has subverted this board.

    Yet ANOTHER fine reason to move back to TX. (Besides that the dang things don't do ya much good un-loaded.)

    Yup, in Texas its legal to walk down the middle of the road with a loaded shotgun. Only problem is when you get into municipalities or counties that might have laws against it. And some advise, carrying a gun in your back window on display for everyone is just an invitation for having your car broken into.

    My advice would be to just get a CCW Permit, and carry a handgun on person, and a loaded carbine or shotgun in the trunk.

    Tis a shame; when I was a kid (9yrs) I carried a .22 rifle with me everywhere and never was thought of a killer-and I wasn't.
    We in Texas still have rifles/shotguns in the rear windows of our trucks, and if you don't cause problems- it's ignored! It's legal and fine- loaded or unloaded. We are a great bunch!!!

    Daddo- you can still do that, it just depends on where you live. If you live in Rural Texas you can carry you 22 all you want. But if you live in the middle of Houston, you might have some problems.
