Man convicted in gun sales2002-04-06By Jean PlumbergThe OklahomanA Hinton man has been convicted in federal court of selling firearms without a license. David Thomas Kubowski was indicted in December on one count of having more than 380 firearms for sale without a federal firearms license, and one count of lying to agents of the U.S. Bureau of Alcohol, Tobacco and Firearms when questioned about the sales. A jury found him guilty on both counts after deliberating for 11/2 hours Thursday. Kubowski admittedly sold handguns and other firearms out of the Hinton Country Inn, a motel, convenience store and gasoline station. At issue in the trial was whether his firearms were part of a personal collection or a business inventory. "These guns were sold without any federal background check. There was no federal paperwork done," Assistant U.S. Attorney Ed Kumiega said. "This is not a hobby. It's a business," Kumiega said during his closing argument Thursday. "And if it was a hobby, it's a hobby to make money." Defense attorney Scott Adams said, "You can sell all or part of your personal collection without a license, and that's uncontroverted."
