Washington-AP -- Hustler publisher Larry Flynt has lost the first round of his battlefield-access lawsuit, but he's calling the ruling a success.Flynt is suing the Pentagon for the right to send reporters out with U-S forces on combat missions in Afghanistan.U-S District Judge Paul Friedman denied Flynt's request for a preliminary injunction today, but Flynt is praising the judge for saying the First Amendment could establish the media's right to be present on the battlefield.At the time Flynt requested access, soldiers were entering Afghanistan only in small numbers on highly specialized missions. Now that hundreds of Marines and other military forces are in the country, some restrictions on reporters are being lifted.Flynt wants the judge to affirm that journalists have a constitutional right to document front-line hostilities firsthand.

    That's fine. Let 'em go. BUT....Tell 'em they'll have to be able to protect themselves. "Oh, I can't carry a weapon, I'm a journalist!" Our GI's aren't there to nurse-maid reporters. Maybe you active GI's can educate me but I don't recall anything in the field manual (or anywhere else) that says you have to provide cover for someone who is unwilling to cover themselves. Not "unable" to provide their own cover....but "UNWILLING".Mudge the warrior
