Judge's husband shoots, kills bear in couple's home

POLSON - District Judge Kim Christopher's home was broken into last weekend. Her husband, Terry Janeway, shot the intruder seven times with a .45-caliber handgun at close range. Christopher was also armed with her own 9mm semi-automatic, but did not fire her weapon.



"She was my backup. She had her gun out," Janeway said.



The 300-pound, four-legged intruder managed to escape out the kitchen window whence it had entered moments before. It fled on foot, leaving the kitchen a mess, but harming no one.



"If that bear had come further into the house, and gone downstairs, it would have got into the pantry. Or upstairs, we have a 4-year-old and a 1 1/2-year-old. That would have been tougher to deal with," Janeway said Thursday, recounting the incident.



The wounded black bear escaped, but died later, probably that night. Janeway and Christopher found its body Monday in a wooded area near Meadow Road about a mile from their hillside home in the Jette Meadows subdivision, seven miles north of Polson.



Bears are relatively common on forested tribal land about two miles north of the couple's home. But their home in the subdivision is in open country, on a steep hillside overlooking Flathead Lake, with no water, trees, brush or other amenities for wild animals. Janeway said they have lived in the three-level home for six years, and had not had a bear visit until last weekend.



But there's always a first time.



A bear - doubtless the same one - entered their garage Friday night about 4 a.m. They had left the garage door open to cool off the house. They were awakened to the presence of the bear by the barking of their dog.



"Kim got up, called the dog in, and was about to close the garage door. She hit the button and the garage-door-opener light started flashing, meaning something was in the way. She saw this * bear walking away.



"I got up and grabbed my gun and flashlight. It had scampered out, but it had drug a 50-pound container of dog food outside, and had been eating on it," Janeway said.



Janeway contacted the sheriff's department and Confederated Salish and Kootenai Tribes wardens. He was warned the bear would probably be back, since it seemed to be an aggressive bear, accustomed to human habitation.



"So Saturday night we closed everything up, all of our sliding doors, all of our windows except one kitchen window off the deck. We left it open about 2 inches for ventilation. About 1 a.m., I heard a clanging noise, the noise of something dropping. I figured the bear was on the deck - we had left the grill out on the deck. I got my .45 Beretta and went downstairs," Janeway said.



As soon as he turned the corner into the kitchen, Janeway saw the bear crouched on the kitchen counter above the sink.



"It had ripped off the screen, slid the window back and climbed on in," he said.



The bear started to turn around, so Janeway aimed and started firing.



"I shot seven rounds. I had eight in the magazine, but the last one jammed on me, I was firing so fast," he said.



He went back upstairs to reload, but couldn't find another magazine in the dark. Fortunately, his wife had her 9mm handgun handy. He took it back downstairs, but the bear had disappeared.



Armed with his wife's handgun and a flashlight, he went outside and looked for a blood trail, but found none.



"There was nothing out there but claw marks. He had put deep gouges in the decking," he said.



Much of Sunday, Janeway searched for the bear in gullies and woods north of his home, and the bare hillside as well, but found no sign of it.



On Monday evening, Janeway and Christoper took a walk down Meadow Road, the main arterial through Jette Meadows and spotted the bear, dead under a tree, a few hundred feet from the road.



With permission of tribal fish and game, a tribal member claimed the carcass and took it to a local taxidermist.



Janeway said he heard it measured 7 feet from the tip of its nose to the end of its tail - a very large, mature, male black bear.



He said he was mystified why the bear ventured so far out of the woods into a built-up subdivision.



"There's no trees, water. Why would the bear come all the way down here? Apparently the reservation is overpopulated this year with bears," he said.

    Biker dies in stabbing after approaching woman

    A 38-year-old man was stabbed to death by a woman who says he attacked her in northwest Harris County early this morning.

    Harris County Sheriff's Department deputies were called to the 21000 block of Cypresswood near FM 1960 about 1:30 a.m. by the woman, who also was flagging down passing cars for help.

    The 30-year-old woman told deputies she went out to walk after having a fight with her boyfriend. When a man riding a bicycle approached and began speaking to her, she told him to leave her alone and continued walking.

    The woman said the man got off his bike, grabbed her by her backpack and wrestled her to the ground.

    The woman told deputies she fought back using a knife she kept in her pocket for self-defense. She said she does not know the dead man.

    The man was dead at the scene of the fight. The woman is being questioned by detectives. Neither has been identified by authorities.

    Police: Robber tried stickup
    at Dairi-O with unloaded gun

    BISHOPVILLE - Police are expected to file charges against the teenager who they believe planned to rob a local ice cream parlor with a stolen unloaded .357 Magnum, but was shot by the store operator.
    Police interviewed Jessie Slater III, 18, of 1391 Herndon Road, Bishopville, Thursday at Carolina Pines Medical Center in Hartsville. He is listed in stable condition in an intensive care unit.
    Capt. Thomas Burke of the Bishopville Police Department said officers wanted to thoroughly investigate the incident before filing charges.
    "We're just going through the process," he said. "We want to make sure that we dot all `I's and cross all of our `T's."
    Bishopville Police Chief Nicole Simon said her officers are waiting for Slater's condition to improve before filing charges.
    Jake Boykin, one of the operators of the Dairi-O, was taking some trash out of the back of the store when he was approached by a teen who asked for a light for his cigarette, reports state.
    As Boykin was reaching into his pocket for a lighter, the youth pulled a pistol and told him to hand over his money, reports state.
    Boykin, who has a concealed weapons permit, then pulled out his pistol instead of a lighter, reports state.
    As the teen advanced, Boykin fired at least twice, hitting the teen once in the left shoulder area, reports state.
    A Bishopville police officer in the area on routine patrol heard the shots and rushed to the scene before Boykin could call police, reports state.
    The suspect took off running, but collapsed in front of Young's Food Store on North Main Street, about a tenth of a mile away.
    Police say they found a gun in a field a short distance away from the Dairi-O.
    Burke said the fact that the gun was unloaded does not lessen any potential charges the police might file.
    "It was dark, he (Boykin) didn't know it was unloaded," Burke said.
    Investigators say Boykin was justified in shooting.
    "At this point, there is no contemplation of filing any charges against him," Burke said.
    Boykin has declined to comment.

    Man Shot During Home Invasion
    Gun Went Off During Struggle Between Intruder, Resident

    JACKSONVILLE, Fla. -- One man is in the hospital Friday morning with a gunshot wound, and police are still trying to figure out who shot him.
    Police believe the Robert Williams, 27, broke into a 5th Street home at 4 a.m. and got into a struggle with the homeowner. The man's gun went off, hitting Williams in the leg -- but they're not sure yet if he shot himself or if the homeowner finger was on the trigger.

    The man ran from home, leaving trail of blood on sidewalk, and apparently got into a waiting car and was driven to Shands Jacksonville Medical Center. Investigators with the Jacksonville Sheriff's Office took the homeowner to hospital where he identified the suspect as the man as the person who had broken in the door.

    Police found knife and shell casings in house. Williams will be charged with home invasion robbery.

    Police: Car thief stuck in neutral

    A Gainesville man was discovered by police after he allegedly broke into a car and couldn't get out.

    David Christopher Lander, 51, of 10013 NW 13th Ave. was arrested early Thursday morning after he was locked inside a car he was burglarizing, Alachua County sheriff's spokesman Sgt. Keith Faulk said.

    Matthew Cooper of Atlantic Beach, who was in town visiting relatives, was falling asleep just after 2 a.m. when he heard the car alarm go off.

    "I thought someone was trying to break into my truck, so I grabbed my shotgun and ran out there in my boxers," Cooper said. He discovered that it was the neighbor's car alarm.

    As Cooper approached the car, he saw a man trying to kick out the windows from inside.

    "I went back and told my wife to call 911."

    When deputies arrived, they found Lander - locked in the car.

    "He was trying to hide - all scrunched down in the back seat," Faulk said. "I guess he thought deputies couldn't see him."

    The 1994 Infiniti is equipped with an anti-theft device that automatically locks the doors when the car alarm is triggered, Faulk said. When Lander entered the car, the doors locked.

    "Had he pushed the button on the driver's side door, he could have gotten out," Faulk said.

    Cooper said he was amazed Lander couldn't get out.

    "He was intoxicated for sure. When the cops let him out of the car, I could smell the alcohol all over him," Cooper said.

    The owner of the car, Sandra Boutwell of 10112 NW 6th Place, slept through the incident, Cooper said.

    "She got out there and couldn't believe it," he said. "She was in shock."

    When Lander was arrested, deputies found in his pockets a pendant valued at less than $50 and $3.21 in coins taken from the car. Lander was charged with one count of burglary of a conveyance and one count of theft.

    In 19 years of law enforcement, Faulk said he has never seen anything this dumb - "not where the suspect was caught because of his own ignorance."

    "Maybe he needs a new line of work. He's not very good at what he's doing now."

    This reporter is an idiot. Of the two paragraphs above what do you see wrong? In the first paragraph the reporter states that the fella says "She was my backup. She had her gun out," Janeway said.

    Then the reporter tells us:

    If the lady was backing him up, then why was she upstairs cowering in the bedroom? I hate reporters, get the darn story right or dont write. How effective of a back up would she be firing her 9mm through the ceiling with her X-ray vision? Moron!!

    I was wondering the same thing. I like how that guy got trapped in the car. What retard! I've seen three world's fair, a goat ropin', and buzzards scrumpin; but I ain't never even heard of anything like that.
