Washington - The Montana Shooting Sports Association (MSSA) has files suit again several federal agencies over Endangered Species Act policy making. At issue is whether federal land managers may close federal lands to public use, including the discharge or use of firearms, in violation of an approved land use plan, without amending the land use plan through the statutorily required public participation process.The complaint filed on complaint on September 24, 2001 in the U.S. District Court for the District of Columbia, stemmed from a 1994 action, in which the BLM approved a resource management plan for the Phillips Resource Area in Phillips County, in north central Montana. On September 4, 2001, MSSA notified the U.S. Department of the Interior of its intent to file suit under the ESA."Can federal land managers may create de facto critical habitat for species protected by the Endangered Species Act (ESA) without complying with the process set forth in the ESA for designating such habitat" says Gary Marbut. MSSA Director. He and Dr. Philip Barney are plaintiffs in the case.Under the plan, public lands in south Phillips County were open to multiple use, including the recreational shooting of unregulated wildlife. In October 1999, without notice or opportunity for public comment, 20,000 acres in this area were closed to the "discharge or use of firearms." The stated purpose for the closure was "to protect habitat for the reintroduction of the black-footed ferret," says MarbutThe Defendants are listed as: Secretary of the Interior Gale A.
