a slightly different Class III/NFA question

I've been following the "Class III/NFA question" and I think it's time to ask my question that's been puzzling me for awhile.Let's say John D. has a machine gun for sale that I want to purchase. I have to go through the legal stuff to get approved and pay the $200 for that specific firearm. From what I understand, this can easily take 6 months or more. So I pay John D. now and he holds on to the machine gun till I get approved? If he's John D. Private Citizen then he ships the firearm to the Class III dealer who is handling the transfer after I've been approved, right? And if he's John D. Class III dealer, he just puts the firearm in the back room till I get approved?My confusion is really the "when do I pay for it" and "where does the rifle sit until I get approved".GL

    Green. Most NFA class 3 are a 50/50. You pay 50% up front and the balance after your paper work is approved. Shouldnt take 6 months, maybe 30-90 days provided your paper work is in order.

    I cannot speak about shipping; but, if the Seller lives in the same area as the Buyer, no Class 3 dealer is required at all. Class 3 dealers don't advertise this fact. Do the paperwork with ATF, pay the $200, get ATF approval, hand the gun over...done deal.

    stupid question on the same topic...can anyone apply for a class III license? Say I want to buy a machine gun for whatever reason, pending all the necessary paperwork and approval, I can purchase the gun? Are there any restrictions or pre-requisits for applying for a class III license?once again, pardon my ignorance. I think im gonna go out and buy some books this weekend and study up some on laws and firearms.Thanks in advanceAlex

    I was told at the last gun show by a Class III dealer I ran into that basically anyone who can qualify for a carry permit can qualify for a Class III, it just takes longer. He had some nice wares on the table, for $4000 and up...

    pikeal.. If your asking about Class 3 dealers lic. Im not sure what hoops you have to jump through. It use to cost $500 a yr but I think it went up to $1000. If your referring to a Class 3 on a form 4. Call your BATF office and have them send you the forms. Get your finger prints taken by local state police or if they dont do it ask who they refer. Get a pass port pic and submit to your local PD. The sherrif of my county wouldnt sign so I sent it to the local pd dept and the chief signed, After you have both copies signed, send to BATF and they do the national background check, They send you 1 of your originals back with a tax stamp. You get to go shoot and then save money for the next time lol. Because you just cant have 1 machine gun. I asked a couple buds what they put down for the reason they wanted the gun. For collecting and shooting at a range. Funny because thats just what I do, Good luckKidd

    thanks! Now all I have to do is win the Lotto so I can stock up on toys before they all get banned. I knew I got into this gun thing too late. Its so depressing to see all these articles against guns and such...makes me wish I was about ten years older. I'm sure I would have had a nice collection by now.Thanks for the info guys.

    Pike.....make that about 20 years ago and you'd be right. Class III weapons for civilians were cut off in 1986.Mudge the early bird

    in the words of Ned Flanders (Homer Simpson's neighbor)"gosh darn it to heck!"Thanks for the info. But if I remember correctly from a different post, so long as the gun was made (and put together) before then, it is considered pre-ban and can be bought no? or am I just screwed every which way?
