Gary, Indiana, case dismissed per Ruger PR

COURT OF APPEALS AFFIRMS DISMISSAL OF GARY, INDIANA'S LAWSUIT AGAINST FIREARMS MANUFACTURERS

SOUTHPORT, CT - September 23, 2002 - Sturm, Ruger & Company, Inc. (NYSE: RGR), the nation's largest firearms manufacturer, is pleased to announce that on Friday, September 20, 2002, the Indiana Court of Appeals affirmed the January 12, 2001 dismissal of the City of Gary's complaint as to all firearms manufacturers on all counts, including allegations of public nuisance, negligent distribution and marketing, failure to warn, and negligent design.

It reversed the dismissal of the case only against three local retail dealers based upon specific allegations made by the city against these three dealers of knowing and intentional illegal sales. The city must now attempt to prove these claims of alleged criminal activity by the dealers.

The Court of Appeals held that the lawful sale of firearms pursuant to state law, and the heavy regulation of firearms distribution, precludes the city's "public nuisance" claim. It also dismissed the city's claim of negligence as to all manufacturer defendants, based upon established principles of law and the right of individuals to lawfully own firearms as recognized by the Indiana Constitution.

In dismissing all firearm manufacturers from the case, the court quoted from an opinion which held that "(public) nuisance always arises from unlawful acts, consequently that which is lawful cannot be regarded in a legal sense as a public nuisance". It also stated that none of the manufacturers "have close relationships with the city", nor do they owe "a duty of care to the city. Absent a duty, there can be no negligence".

    dads -- This is a Public Relations release written by Ruger's ad agency. Largest could mean what it says in terms of sales, or it could mean square footage in their warehouse. Be careful when reading PR notices....
