NICS check?????

I saw a cool looking gun in my local gun shop this weekend and wanted it. My wife is starting to limit the ammount of money I spend on guns so I took one of my old guns in to sell to them so I can put the money down on the new gun. I tought that they where not saposed to run a nics check on you until you take the gun home. They guy said thaey had to run the check to buy the gun from me. Is this true. I live in VA . I never sold a gun to a FFL before.

If you will blame gun makers for every shooting then blame car maker for every car accident.

    At the top of form 4473 there is a "warning that states you may not receive a firearm if prohibited by Federal or State Law. The information you provide will be used to determine whether you are prohibited under law from receiving a firearm". The form 4473/NICS check is for receiving not selling a firearm. However, the NICS check can be run up to 30 days prior to you taking delivery of a firearm but Section C of the form would have to be signed and dated by you at the time you pick up the firearm within that 30 day time period.

    All I know is that the guy told me he needed my ID so he could run the check while I did the transfer papers. It did not take very long mayber 4-5 mins and then he was back with my ID.

    Here in Florida they make a call on the gun you want to sell to see if it comes up stolen. and give you a purchase paper, transfering the gun to them from you.

    Our background check takes about 5 min.

    No, you don't have to run a NICS to sell/trade your gun in VA. Many dealers in the area require you to fill out a psuedo-4473 (without the questions)just so they have the info to enter in their 'bound' book.

    Punchie you work at the gun store I am talking about. The old guy with all the grey hair took my ID and said let me run the check while you fill out the paper work. Whats all that about?
