Tax On Shipping, Mild Rant

Some states require vendors to collect tax just on the sale price, and others require vendors to collect tax on the entire price, including shipping. Texas is in the latter category.

So, for in-state sales, I calculate the tax on the item and shipping, and give the buyer the total. Several times now, I have gotten arguments from the customer, not wanting to pay tax on the shipping.

One even took it on himself to re-calculate the tax, on the item only.

In most cases, we are talking about 6.75% of $6.00!!!

41 CENTS! People get bent over 41 cents!

Can you believe it?

    We have the same nonsense in CA. The section below the second paragraph outlines the duty of the dealer to collect sales taxes on shipping and any handling fees. Only the state mandated Dealer Record Of Sale, which is California's background check for perspective firearms buyers is not subject to tax.

    We don't use the National Instant Criminal Background Check System(NICS) here.

    Fortunately when I lived in Kalif. my FFL transfer dealer believed that tax was not lawful, and refused to collect it. The courts last ruling that I was aware of in Kalif. (that was 15 years ago) is that the transfer dealer was not a party to the transaction of the sale, therefore cannot collect taxes from which they are not a party to. Not all FFLs agreed to this definition, and some collected the tax and pocketed it.
