Trooper Unfairly Fired For Extramarital Sex Incidents
A judge says the state Highway Patrol was wrong to fire a state trooper for having extramarital sex with a woman in his car and at a district station because other troopers who did the same or worse remained on the force.
Monty Steven Poarch was fired in 2003. But evidence in the case showed that another trooper who also had an affair with the woman was suspended without pay for five days.
Administrative Law Judge Melissa Owens Lassiter's decision this week calls for Poarch to be reinstated with back pay.
The state Highway Patrol says it will appeal the decision.
Another administrative law judge and a Wake County Superior Court judge both ruled in the case that fired state employees who want their jobs back can see if agencies are consistent in applying discipline.
Poarch is now a lieutenant in the Caldwell County sheriff's department. His attorney, Michael McGuinness of Elizabethtown, said Poarch is grateful for the decision and wants his job back.

Use a pun, go to jail.
Sex at the office and in your issued car (if it was his duty car) is plain wrong. If that is the case, he should have been fired and not reinstated.
If the other trooper just sexed her up, but not at the 103, or in his car, it is not a comparison.

from what i have seen when a trooper sees a couple having sex in their car they are arrested. he should be arrested too.Been in this business a long time. The only times I've seen anyone taken to jail for having sex in a car was when they were doing it solo.

That said, I have zero sympathy for an officer messing around on duty, or for anyone who commits adultery.
Like Txs, I too have encountered quite a few folk getting busy in cars, but have never arrested any of them unless they happened to have an outstanding warrant.
