Ruger P-90 Update..(not good)

I don't know how many of you remember me winning this bid, thanks to the help of this Forums members, but I have had nothing but problems with the seller from the get go.

I won the auction on 4/21/02. I live in FL. and he lives in CT. so the check had to travel approx. 1600 miles. He received the check on 5/02/02. The morning before he received it he E-mailed me and said he was going to re list it after I already told him payment was on it's way. Then he E-mailed me and said he received it but my FFL holder's license wasn't valid so I mailed an extension certificate to him. He E-mailed me later on 5/02/02 and said he would ship the gun after the FFL checked out and the check cleared.

Well the FFL checked out and now he is telling me the check hasn't cleared yet. After calling him, several times he said he went to the bank on 5/21/02 to see why it hasn't cleared and would let me know when it does. I have Quicken 2001 Deluxe and download my bank account every day. Wouldn't you think that after two weeks you would wonder why the check hasn't cleared? I don't think he ever deposited it. I pretty sure, he either sold it for more money or changed his mind.

I called him today at 4:30pm and he told me he was in the middle of something and would call me right back. He didn't call. I called again at 7:30pm and was told he was not home but would call me when he gets in. It's obvious to me I am dealing with someone very young by his tone of voice and mannerisms.

I am out $30.00 for the FFL papers being sent plus I bought accessories totaling $75.00 for a total loss of $105.00 plus a check for $291.00 floating around.

I just reported to Gunbrokers as having paid but have not received the merchandise. I wish I sent a U.S. Postal Order now. I do have an E-mail from him stating that he received my check in the mail and hope that is enough for the U.S.P.S. to do an investigation.

Anybody else have any ideas?

    Send him an e-mail saying you want to "run a trace" on your check and ask him what bank branch he deposited it in. If necessary, call that branch and get their bank number, or ask the seller for it. Then call your bank and ask them what they can do to help you find where the check is in the system.

    I wouldn't have handled a transaction this way. In the first place why would your dealer give you an expired FFL to send the guy? They owe you a $30 refund if you don't receive the gun in any case, since they get paid not to hand you a copy of their FFL, but rather to handle the transaction and fill out the 4473 once it arrives.

    In the second place, I never try to pass my personal checks to sellers. Sellers don't care about my convenience or my pride in my reputation. I go to the supermarket and get a Money Order (for under a dollar) because I know sellers like them better because they are pre-paid. Nowadays of course I often use PayPal and they have their money instantly.

    In the third place, while I understand your enthusiasm in buying accessories before the fact (I've done it myself), that's too bad. The seller is not liable for your other purchases.

    Fourth -- an auction win IS a contract, if hard to enforce at times. The kid took your check, so you have the right to, at the very least, cancel the transaction and stop payment on the check. Maybe you should ask him if that's what he wants you to do. Yes, you'll be out the cost of the stop-payment, but it's a lot less than $291. And a lesson learned. Keep your personal checks. Sellers generally speaking don't want them, and it's not to your advantage to have someone waiting an indeterminate length of time to decide your check's good. And be sure when you send somebody an FFL it's a valid one the first time around. Some folks just get tired of messing with a situation, and I don't want my sellers (given that they are human beings with a variety of personalities, many of which are borderline) to have any reasons to balk.

    That's a crapy deal man. I like to stick to money orders myself because you never know who you are dealing with. Best of luck to you.

    I gave my check and pre-paid envelope to my FFL holder who made a copy of his FFL and mailed it off.

    I had no way of knowing the FFL was expired but he did have a six month extension, which I mailed to him as soon as I found out.

    I used a Check because I had a problem with a seller who took six weeks to send me some parts I won. I used a Postal Money Order for that.

    Anybody know how to handle this?

    I also call my FFL and he sends it out. I pay the $10 when I pick up the rifle. I also have 3 or 4 copies of his license I keep when I travel to out of state shows or dealers. I can give it to them and the rifle sometimes is here before I am.

    The seller E-mailed me 7 times today and asked me if I want my check back or just rip it up. He never did deposit it and now tells me he doesn't have the gun anymore. He also claims I am threatning his family by calling him. After a month of having my money he is backing out of the deal.

    I am sure you know what sort of feedback to post, I would also send a note to admin clearly summerizing the course of events. Sorry you missed out on the pistol. Probably best to assume it was not much better than the seller.

    Just for your info, using a USPS money order DOES NOT provide any protection.......they don't care if someone rips you off.
