restraining order

well, i finally had to put a restraining order against my neighbor. He has threatened me twice now. I feel a little bad because i just read that he has to surrender his gun to the sheriff's department. Well, i guess that's what happens when you tell someone that you're going to shoot them. I learned from his mistake so it WAS worth my $50.00. Hopefully, he learned too! I doubt it though, you can never unstupid the stupid people. right??? Anybody know what to expect at the hearing??? Hopefully he'll get the point that i prefer not to be contacted by him and his wretched, man looking wife and LEAVE ME ALONE!

    Whats the origin of your problem. Is this the neighbor whos dog scratched up the door? Or was that someone else?

    When Clinton left office they gave him a 21 gun salute. Its a damn shame they all missed....

    Your question regarding the hearing would be best directed to an attorney in your area familiar with the particular details of the court procedure and law in your jurisdiction. Prosecutor's office may or may not be able / willing to give you a quick summary.

    I just heard that 2-week restraining orders do zero good, but that 1-year restraining orders have some beneficial effects, statistically speaking.

    MMMM its not a good situation just contact the guy, tell him is more cheap to buy you the house than to get a lawyer for defending him for killing you, and MOVE away from the darn place.....

    Dont live in houses you can hear your neighbors snores.....

    4godandcountry, yes it is the idiot who's dog scratched the door. Every time someone ELSE shoots he comes outside and starts running his mouth. I ignore him and then call the sheriff out. He has nothing educated to say, he'll threaten to kick my butt and then say things like "I got you shooting on video" which is stupid because it's always after i pull up from work so it be impossible because i was gone. Even if i did, who cares! I warned him through the deputies that i would get and order of restraint if he did it again so he got what he deserves in my opinion. I do feel bad about him giving up the gun but it is a crime to have a gun and not fire it.

    Azzeater,I realize you were put in a tough spot,but you did the right thing.As for your Court Day you should call the DA and ask what to expect? After all you pay his Salary and they are Public Servants just like LEOs.I think you covered your tail pretty well by getting the Restraining Order,if an Assault occurs or he violates the Restraining Order,call the Sheriffs Office and he will be locked up fr Violation of the Order.Avoid contact with him as much as possible.And keep your cool the Law is on your side.The Judge may order an Injunction against him for his ignorance.And he will be ordored to keep his distance.If you are in Doubt of anything seek Council.He messed up you didnt,so dont feel bad for what you did for your family and your self.

    If this guy said that he was going to kill you!!! DO you really feel bad they took his guns??

    If you will blame gun makers for every shooting then blame car maker for every car accident.

    thank you all, I see that it has motivated them to finish teir stockade fence so at least one good thing has come from it so far.
