Sheriff's Deputy Enters Plea To Weapons Charges

LOS ANGELES -- A sheriff's deputy who holed up in his Woodland Hills home for about four hours Monday pleaded not guilty Wednesday to felony weapons charges.

Brinton Gerald Marsden III, 43, is a 16-year department veteran who was on leave and was despondent about being unable to return to work, according to the District Attorney's Office. Police in riot gear were sent to his home on Abbeyville Avenue about 3:30 p.m. Monday after neighbors reported hearing six shots, authorities said.

An elementary school where some 25 students were participating in after-school activities was locked down after the shots reportedly were fired.

Marsden surrendered at about 7:30 p.m., Monday. There were several weapons in the home, according to police.

Marsden pleaded not guilty in Van Nuys Superior Court to two counts of assault on a police officer with a semiautomatic firearm. He pleaded not guilty to one count each of exhibiting a firearm in the presence of an officer, possession of a machine gun, possession of an assault weapon. and discharging a gun with gross negligence.

He remains in custody on $1 million bond. He will return to court Nov. 1 for a preliminary hearing.

    If he was dispondent, how come his fellow officers did not remove all the weapons from his home prior to his going on leave?
    What is he doing with a machinegun at home, they are illegal in Cali!!
    Another reason California officers dont need AW's or M/G's.
    If its not good enought for the law bidding citizens to posses then it should be illeagal for the cops too!

    It is illegal for the police in cali to possess personal unregistered AW's or Class 3.. They can only purchase items like that with departmental letterhead documentation for use in the line of duty.

    I prefer to wait till the smoke clears on this one. The media would love to do a snow job on a cop who believes in and supports the second ammendment.

    Was the gun displayed in a threatening manner? "Exhibiting a firearm in the presence of an officer" In other words; don't show anything in your collection to a fellow LEO in Cal or you might get jailed.

    Was he merely protecting what was his with an unwarranted entry into his home? "neigbors hear six shots". Were these shots at someone?Thus he fired warning shots into the air. Then again maybe it's all a legit situation on behalf of this fellow officers to arrest him. If so, he's no different than the average Joe. Media; been there done that.

    Like I said I'll let the smoke clear.

    Harley.... I agree with you 100%. Wait to get all the facts, then pass judgement if you must.

    Iamaclone... If YOU are off work injured, do your fellow employees or the police automatically come to your house and take all your guns, NO. Appearently he was not despondent when he left work, it was only when he learned he would not be able to return that he became despondent.

    Another reason to take away AW's & MG's from police, yeh right!
    The reason police need heavier firepower than the average citizen is simply because they get in more shootouts.

    Machineguns are legal in Cal if you have a license for one. I dont know if he was licensed or not, lets wait and see.

    Warning shots in the air are illegal in cali.

    Grossly negligent discharge (which is a wobbler charge can be misdeamenor or felony), warning shots into a valid backstop probably are legal.

    I do think there is alot of room on this one also, it sure sounds like they threw the book at this sheriff deputy and the actual plea bargin/ trial results will in all likelyhood be far less then the extent of the charges at this point.
