And you have to give credit to the originator of this topic for creating a title rivalling some of the cheaper newspapers. "Man, 65, kills teen who knocks him off bicycle" is just as bad as "Girl, 18, kills man who knocked on her door" then reading the article to find that in addition to knocking, he was kicking the door in and trying to butcher her with a knife. That will depend on their state law. Does that state have a "felony murder" law? I know Nevada does. If anyone dies because you commited a felony, you can be charged. That includes victims, witnesses, and even your own partners.

65 year od man didn't call the play. Those kids did. He reacted to in a way to save himself, with the means at his disposal. I expect most of us would have done the same thing. I also expect most of us would regret the taking of another life, no matter how justified it was. Hopefully, he fully realizes that he was put in a position from which he had no other choice, other than to be beaten, and possibly killed.
With their past records, I expect at the very least, he saved someone else from being killed by them on down the line.

for a couple years i lived in the N.W. section of the city, neatr where this happened and watched as within a 2 year stretch it fell apart
towards the end, it was a common thing for me to be standing in front of the house holding on some bunch or other waiting for the cops to make an appearance, half the block standing behind me
and not ONCE did any of the responding officers question who i was, did i have a permit to carry etc.
one said years later when i met him elsewhere that "the neighbors were all behind you, no need to worry about you"
next block either way were real bad
within another 2 years after we moved out, most of the other residents had left and given in to the punks, there is now a regular drug house in operation on the block
lucky for the old guy, "castle doctrin" was passed and instated not long ago in Pa which also includes protection from suit by survivers of the dead punk
but un-fortunately that does not help him if the kid was involved with any of the local gangs

A 65-year-old man who was attacked by three boys in Berks County on Wednesday and fought back by shooting two of them was the third victim of their robbery attempts, police said.

The man was riding his bicycle about 11 a.m. on the Thun Trail near the Bertolet Fishing Dock in West Reading when the boys knocked him off his bicycle and pinned him against a fence in an apparent robbery attempt, police said.
Two of the boys were assaulting the man when he pulled a handgun and shot them, police said.
Berks County District Attorney John Adams said Thursday that the teens are accused of robbing two other men prior to the robbery attempt on the 65-year-old man.
Julias Johnson, a 16-year-old on probation, was pronounced dead at the scene. The other boy, a 15-year-old whose name was not released, was taken to Reading Hospital with a single gunshot wound to his neck and is expected to survive.
Police said they took the third teen, Michael Gonzalez, 16, and the victim to the Cumru Township police station for questioning. They consulted Adams, released the victim and sent Gonzalez to the Youth Detention Center.
Adams said he does not condone violence but said the man had no choice but to defend himself against the teens.
Adams said the victim did not provoke the attack, could not get away and feared for his life. He added that he will not be pressing charges against the man who shot the teens.
The teens are accused of robbing two other men earlier that day.
The boys had skipped school that day, Adams said. Probation officers placed an electronic monitoring device on Johnson's ankle after visiting him earlier Wednesday.
For missing school, Johnson was supposed to report to the probation office Wednesday afternoon, Adams said. Johnson was on probation for prior "criminal activity."
The injured teen and Gonzalez attended Governor Mifflin School District. Johnson attended the Reading School District.
