Selling to an 03 Collectors FFL

Can anyone tell me if it's legal to sell a modern firearm to a person thru Gunbroker.com and use his 03 Collectors FFL number as the receiving FFL? We always use an 01 FFL so I don't know about the 03 FFL. Thanks

    ....If indeed it is a modern firearm, not on the C&R list, and cannot be proven to be 50+ years old....then, no....An 03 C&R FFL cannot recieve a modern firearm. It must go to an 01 (dealer).

    The C&R license is just that, for C&R qualified items only. Modern guns must go to a regular FFL dealer for transfer.

    And also remember tha unfortunately C&R holders cannot ship or receive C&R handguns via the US Mail.

    There might be a handful, just a handful, of modern-type handguns on the C&R list, but they seem to be one-of-a-kind presentation pieces. I recall purusing the list of approved guns sent by the ATF. Great reading.

    Just think: A WWII 1911, all beat up but functional, for $400, can be shipped to an 03 holder, while a nearly identical 1957 Colt 1911 cannot.

    As the folks said, unless the "modern" arm is on the ATF C&R list, the C&R license is meaningless. Fr'instance, ALL Colt Woodsman and pre-Woodsman pistols ARE on the list, and could be shipped to a C&R- without having to be 50 yrs old. On the list, made 50 yrs ago, or has letter of approval from the BATFE. Otherwise get an 01 to recieve. And he was told that when he got his 03 C&R FFL.

    There are a lot of "modern" guns that it could be argued that the C&R lic. is sufficient for transfer.....like the Cimmaron copies of the old Winchesters...and other copies like that, but these things will end up costing hundreds of thousands of dollars in legal fees and years of aggrivation if the ATF comes after you because of this.

    I would just use an FFL for all "gun" transfers...unless it is VERY certain that it qualifies.....like an 1860 derringer, or a comperable ancient collector peice. Even if it is a perfectly legal thing to do...why risk having to prove you were in the right when it is SO easy to avoid the whole thing?

    He's a good gun dealer.

    The majority of 01 FFL holder's in America don't recognize a 03 FFL at all.

    Locust- a modern copy of a C&R is NOT C&R. Argue away, but the ATF regs are pretty clear. Example- a Winchester 1897 12 g pump made in 1910- C&R. The Chinese COPY of the same gun, made last year is NOT C&R. The determining factor is the age of THAT particular weapon. A Marlin 39A made in 1955- yep. Made in 1958- Nope- not yet. Don't confuse C&R and antique. As far as whether an 01 dealer "recognizes" an 03- it is their choice who they sell to. I find a lot of folks that do not know what an 03 covers. Happily, since I am on 03 holder, I find plenty of knowledgable sellers that I buy from to add to my collection. Have had some folks that gush "Oh, but if you make one mistake, they are going to send you to jail!"- yeah- and I carry a handgun- same thing applies there. Anyone here that plans to stop legal carry because a mistake could subject you to prosecution?
