I'm past sick of the "system"

I was working in Wisconsin recently and had my girlfriend with me, we were there for about three months. When we get home she has a letter in the mail from LFUCG stating that her license had been suspended for failure to pay fines and failure to appear in court. Apparently somebody has used her identity and received a no seat belt ticket and had no drivers license with them. So my girlfriend calls the courthouse, tells them whats going on and they advise her to just pay the ticket of twenty five dollars; When she got off the phone and told me this I was bleening furious! She didn't receive any ticket we were both out of state and have at least 10 people that can verify that. Well I told her to call the state police and tell them, since this has crossed county lines about 120 miles from where we live. She calls the state police these guys take her information and tell her they'll call her back, and they did about 10 minutes later; Where they inform her that she will have to take this matter to Fayette county and deal with it there.

I took her to the courthouse, where the clerk was extremely rude and also threatened to call the sheriff on me if I didn't go sit in the waiting chairs. I called her an old * and left!

I see no reason why She should have to drive such a distance to do the states' job! The way this is all set up is BS!

Anyways some advice on the situation at hand would be nice and appreciated.

    Well unfortunately it sounds like you did everything possible in this situation besides go take care of it in court. Good luck and I'm sorry you had to be another honest American screwed over by the system.

    You need to be polite when you deal with these bureaucrats. You must have been pretty rude for the clerk to threaten you with arrest.
    You had a run in with a female a while back where you got a little hot headed.

    I had a similar problem in Florida, after I had moved to OryGun. I resolved it with letters which I FedEx overnighted to DMV and the Court there. It took about a month, but it got fixed and was removed from my license.

    If a suspension remains on her record, her insurance will skyrocket.

    Don't plan on getting it resolved quickly, easily or cheaply.

    How does someone get stopped with no license and get off with a "no seat belt" ticket only?

    I would be as nice as possible and ask for the name of the officer that wrote the ticket, then ask to speak with him. Arrange a face-to-face and hopefully he would remember and could tell that the person he gave the ticket to, was not your girlfriend.

    Then I would get a description of the person he ticketed, may be someone you know.

    you have to bring your license to the courthouse when you go pay your no seatbelt ticket, otherwise you will probably be locked up.

    In this state apparently all you need to know is someones name and birth date for ID, or at least to get a ticket.

    Guess I assumed the person who got the ticket was driving when this happened. That is why I was wondering why just the no seat belt ticket. I assume from your name, you are in KY. Me too. Never had to show my license at the court house the one time I got a no-seat belt ticket. Just the ticket and the money were all they were interested in!

    A guy I worked with got arrested and had to post bond for a failure to appear on a DUI charge. His uncle's step-son had used his name.

    Of course, the honest man never got any compensation for the lost time at work, having to post bond, or anything. His only consolation is that the bum went to prison for a long time on the DUI and other charges.

    A huge percentage of "identity theft" is accomplished by family members.

    It is a system and you will have to deal with it. Calling someone an old * will not help. You should stay home if you cannot be civil (yeah, you are a victim, we know that, get over it, what you want to do is make it better, not worse). Start again with the court, and be patient, wait your turn, be polite. Otherwise just pay the fine and get on with your life.

    you should be able to get a copy of the ticket, which I assume would not describe your girlfriend. That may and/or may not be enough to prove that it wasn't her.
    You may have to do some massaging of ego. Yeah, I know it's not fun, but just because you are right doesn't mean that they are going to help you.

    did anyone see the movie Bronx Tale ? there is a scene where the young main character has been looking for this dead beat for months over a $20 debt owed to him. finally he sees him one day and chases after him and is about to beat him up. one of the elders steps in and says, "just let the debt go, for $20 you remove a huge headache in your life and you can move on"

    personally, when it comes down to a hassle that could last months or paying $25, i would pay the $25. i know as a matter of principal you dont think you should have to pay, BUT...life can be made much easier if you do. its very similiar to just "turn the other cheek".
    thats my advice. the alternative can be much worse.

    I loved that scene from "A Bronx Tale." What a great lesson in life. I wish someone had taught me that when I was 16, as it was, I figured it out for myself when I was 45.

    I don't agree that it would necessaryly apply to kyplumber's case, however. He is getting screwed by the government and will get some bad marks on the record if he doesn't straighten it out.

    Never a good thing to get all hostile with the court help.

    Maybe if you had just sat down and waited, it could've been resolved in your GF's favor...but you got mad and walked out.

    If the "violation" doesn't count against the driver's record, then I'd just pay and be done with it.

    In the plumbers defense;
    I had a problem with Meigs county Ohio court clerks telling me I had to have an OHIO drives lic to register a car in Ohio. I lived in Alaska at the time, I had a AK drivers Lic.

    I politely asked them where that law was passed. They said it was not a law it was their rules. I raised six kinds of holy hell until I got the clerks so mad they could spit. Then the next sign posted is that they do not accept checks. Why? Because some folks write bad checks for title fees.

    then I realized we the law abiding will always pay for the scum of the earth. Clerks working for the government can't find real work for the most part and need to hide behind laws to keep performing dis-service to the public while we pay them.

    You know, you actually don't have to sign for a ticket, they can issue you a sitation without you signing for it. When you get pulled over and an officer asks you to sign, you are signing that you agree to show up to court on the given date. Its kinda like an insta-arraignment. If you don't sign it, you are arrested and taken to a judge where you are formally arraigned and charged. Most of the time if you recieve a ticket, they will mail you a notice to the address on your liscence letting you know that you've recieved a citation, and that you will need to show up on a given court date or whatever the specific jursidiction does, maybe make you call and setup a date...

    With the ever growing amount of traffic cameras and what not, you better be careful who you let borrow the car, cause they might run the red light, but the ticket goes to the registered owner...

    Yea the system sucks. Its kinda like things will work, then something new will come along and mess things up, and it takes a long time to get adjusted or it might even be makeshift but it will work, then the process repeats again... (like the new traffic cam craze...)

    A copy of the ticket will probably answer some guestions,150 east main street(police dept)

    It's not just a matter of the $25 - the lady's license was wrongfully suspended. In many states there's a pretty hefty fee attached to reinstatement.

    I thought Cook COunty was the only place that sent out bogus tickets to other residence in the state. I paid the ticket rather than go from St. Louis area to Cook County.

    In Illinois, the Sec of Stater Slimeball Jesse White sends out lets stating show us proof of insurance or we will suspend your license. This is the same moron that wants to make it illegal to walk down the sidewalk and text message at the same time.

    If i were to do anything rash, I would probably wipe my * with twenty five one dollar bills and mail them...

    but i would rather them acknowledge the mistake apologize and FIX IT!
