Military Gas Question

Congress allowed the military to have stores to sell goods to military members tax free so their money will go a little further.
It was an enticement to keep moral high and recruitment goals met. To this day they still have AAFES/BX/PX's selling goods on our military bases tax free.....except for gas.
They take into account what the gas prices are in the area and sell it for the lowest price around them...The taxed price.
Why hasn't someone taken AAFES to court for illegally charging Federal taxes for gas with it's pricing method?
