Question for All ... ... ... (FFL related)

I ordered one of those Home FFL kits back in 1998 after ETS, and quickly realized that it was "too deep" for me. I ended up giving away the $35 worth of materials to a friend of mine who owns a few bars here in town thinking he might be interested and better suitted for it... and then I would have a "friend" in the industry. But even he felt these laws were too complex and encumbering.

Many points concerning fire-arms laws have changed since then but my question is...

Is an FFL Holder an Agent of The United States Government?

    Absolutely not. They have certain duties to report certain things (Brady, known or suspected criminal activity related to their business, etc) but they are not agents of the government. Your bank is the same way; banks have a responsibility to report SARS (Suspicious Activty Report), DFN (Designated Foreign Nationals aka terrorists) and large cash transactions.

    Thanks, I could have sworn I saw something on Form 7 about the "rules of agency"...

    I may be mistaken... and I can't seem to find a copy of Form 7 online yet...

    Just a bit of advice for you mrseatle and anyone else who is thinking about applying for an ffl.
    Skip those kits that cost you money and call the BATF and talk/ask questions to their agent while asking for the application for ffl.

    It wont cost you a dime and all the information is available for free from the ATF.

    The forms for an FFL application are very easy to fill out. I didn't spend three hours getting everything set up for mine- including fingerprints, business license and tax number.

    Include anything that you can about your zoning situation- I live in an unincorporated county so I didn't have a lot to include, but I did let them know that. The agent that came out says that the zoning information made her job a little easier.

    Good luck should you decide to pursue your FFL.

    All good advice. would only add that you must have all other (state and local) laws covered- like, say, a business license, sales tax ID, aforementioned zoning, etc etc, AND you must be intending to "engage in the business", and not be looking just to buy for yourself. Otherwise, look at a 03 C&R FFL. does not cover everything, but hey, a one page app, $30, good for 3 years. How much fun were you gonna have with that $30 nowadays anyway?

    wow, are you lucky. the agent that talked to me sat down with her water bottle and proceded to talk for 3.5 hours. i was never so bored in my life. she went over EVERY THING TWICE
