i was due to go into hospital on monday to have a cervical fusion done on my neck...i hurt it at work. i got a phone call from the surgeons office yesterday(friday) saying that they were just notified by the insurance company that they have withdrawn their authority for the surgery. they told the surgeon that they want a report from him before they will decide whether to fund the operation or not. the surgeon reckons that the insurance company is trying to back out of paying for the operation because if it doesnt work they will have a higher liability and will have to pay me out with a lot more money if it fails.obviously if the operation works they wont have any liability except to pay for my rehabilitation after the operation. i have been waiting for this operation for a long long time. it has made me more depressed than i have ever felt in my life, my wife is upset and starts crying everytime she thinks about it, the stress is hitting me big time.
on monday im going to put in an official complaint with the workcover board (government department) and also the insurance ombudsman to see if there is anything they can do. there is no way in hell im going to take any payout from the insurance company...i want my neck fixed, money is no damn good to me if i cant work anymore! i have a letter from the insurance companys lawyers saying the operation has been approved and all i had to do was make the arrangements with the surgeon which i obviously did. officialy i havnt been told why they withdrew their authority for the operation, but i have told my lawyer that he is to tell the insurance company that i will not enter into negotiations for a settlement until after i have had the operation and that they are not to contact me directly or indirectly through my lawyer about anything to do with a settlement.
i feel like doing something very nasty to the case officer from the insurance company, i even found out his address from the electorol roll...anyone can access it here, its an offence not to be registered to vote in this dictatorship.the only thing at the moment that is stopping me from paying him a visit with a shotgun is my wife and daughter...its one of the rare times that i wish i had no-one, whatever happened to me it would be worth it to get the meanie!!!

sorry for posting this, i just have no idea where to turn to with this, i dont know what the hell im going to do now...i was relying on having the operation and getting fixed!

Well that's typical of insurance companys. I'm sure you are in alot of pain, but man, would I be a little skeptical to have neck surgery, but that's just me.

Dan, sorry to hear of your troubles. It seems like everything a guy has to do is a fight. I don't know why that is, but I get so tired of it myself.

So it's a private insurance company or a government agency? Here in the state of Washington employers have to provide on the job coverage through the Gov't unless they're a big company, then they can self insure. Dealing with either the Gov't retards or the ones from the private companies is a real treat.

Hang in there and fight the good fight. Keep us posted on the goings on.

mt357, its a private insurance company, but im going to lodge the complaint with the government department that is responsible for administering the workers compensation act here.
it is a weak act, i have undeniable proof that the insurance company has breached the act 7 times in the last 6 months in regards to my case but there is nothing in the act that allows the insurance companys to be penalised...only the employer. i have talked to an inspector with the government department and he said there may be a back door way of getting the insurance company fined and convicted. he told me to list all my complaints and back it up with the froof that i have already shown him and he will do his best to get them held accountable....all i can do at this point in time is try. it wouldnt be so bad if it was only affecting me, but its affecting my family and our future as well, thats what hurts the most. i have a leaking disc in my neck that 3 neuro surgeons have all siad needs a fusion to fix, so hopefully the workcover board will be able to force the insurance company to pay for it to be done. the operation will cost around $35 000 all up and a from what the surgeon told me "off the record" the insurance company is worried that the surgery wont fix the problem completly and they will be faced with a big settlement payout...no-one seems to believe me, but im really not interested in their damn money....i just want my neck fixed so i can get my neck fixed so i can go back to work!
i`ll post on here again when i find out what has been decided...the stress of it all is getting me down big time.

I understand your pain and frustration and sympathize with your position. However, I think that the caseworker is not the one to blame. He is only doing what his superiors said to do. He probably doesn't have the authority to make such a decision. Hang in there, and keep the faith.
