'My life's in danger now. I can't defend myself, I can't defend you'

An Arizona man has filed a federal lawsuit against some of the state's top judges, claiming they're taking away his freedom of speech and right to own firearms, all because someone didn't like what he wrote on his blog.

"You can't suspend someone's constitutional rights [for blogging]," said Mike Palmer, who is bringing forth the legal action. "Everybody in America blogs or Twitters, so it's a First and Second Amendment issue."

The scenario started when Palmer, a 55-year-old Christian missionary from Phoenix, was online discussing "spiritual death" often referred to in the Bible.

But, according to the suit, a woman from Prescott, Ariz., Melody Thomas-Morgan, complained to authorities that Palmer was threatening her with "death," keeping that word in quotes in her legal filings.

Palmer explains, "It is true that the blog, 'That Woman Jezebel,' talks about spiritual life and spiritual death. ... Spiritual 'death' as in 'The wages of sin is death.' (Romans 6:23) ... It is not true that the blog ever mentions the 'death' of Miss Thomas-Morgan."


Kenton Jones, superior court judge for Yavapai County, went along with the woman's harassment complaint and ordered Palmer to surrender his guns.

"The order says that I am not allowed to possess firearms or ammunition, and directs me to turn over any weapons to the Yavapai County Sheriff's Office," Palmer told WND.

Palmer indicated he does not own any weapons at this time, but when pressed on whether he had any guns previous to the order, he said, "No comment."

"I certainly want my gun rights," he added. "There is no law in Arizona which allows the courts to suspend any constitutional right, but in this instance, my Second Amendment right. And, of course, my life's in danger now. I can't defend myself, I can't defend you. I can't defend my fellow man."

    Kidnapping seems like it would be a violation of a persons 4th amendment rights. I would like to see a similarly stiff penalty imposed, as would be administered to a convicted kidnapper, on judges, law enforcement, and politicians who are found guilty of depriving citizens of their Constitutionally enumerated rights. Maybe that would slow them down a little.

    He hasn't been convicted of any crime. Is this like the gun restriction that is imposed on domestic disturbance cases?

    Sheeeesh! If Sadie Zilch files for a restraining order against me, for any bogus reason, I'll lose my gun rights!

    And I havn't been convicted of anything! Joe

    It doesn't even appear that any kind of threat was made. Just some jerk off Judge wielding their power. Does not even appear to be a legal, or enforceable order.

    Judges are apt to grant the Injunction against Harassment as a matter of habit to be on the safe side. He'll get a hearing within 10 days and this stupid split-tail will have to prove or at least present some kind of case how this guy is a threat to her.

    Unless she's a former girlfriend, or "intimate partner", he'll probably get his guns back.

    How is kidnapping a violation of 4th Amendment rights? The 4th Amendment provides protection from warrantless searches of people, items, property, papers, etc. It has nothing about kidnapping in it.

    Germany has some strict firearms regulations.

    Just about weekly you read in the newspaper about some guy who used gasoline and torched his wife, her new boyfriend, the kids and often a few other families in a multifamily dwelling.

    People get tunnel vision and loose all common sense. It would probably be safer for everybody concerned if they gave him a gun.

    Short of a lobotomy or incarceration, there is no stopping a determined attacker.

    Joe, you just hit on the Utopian goal. Because we like guns and believe in having them, we are by definition dangerous people and shouldn't be allowed to have them. [V]

    May not have anything to do with it now, dam sure he will have to go through the system to get them back.

    Essentially the BATFE is keeping the records via gun point through the FFL system. FFL's are required once they surrender their FFL to turn those into or face penalty.

    Brilliant actually and @ no cost to the BATFE.
