http://thesouthern.com/news/local/communities/westfrankfort/neighbor-threatens-legal-action-over-open-air-pistol-range-under/article_57cb910c-f376-5963-a868-d671509ac83f.html we all feel the same way about the people that move next to a farm or a gun range, knowing what the conditions will be, then filing suit to stop a long time operation... this shoe is on the other foot. the gun range is the one wanting to come in. does the homeowner have a valid complaint?

    From the many precedents I have seen as of late, might as well forget about the range: If something offends just one person, that alone is reason to favor the plaintiff.

    Activist judges, especially those who hate the Second Amendment are going places under Obama and the democrats.

    shouldn't the original owner of a property have a reasonable expectation of safety, security, and normal use of his property without interference? that is always asked of the long time hog farmer when a subdivision is built next door and legalities are begun to shut it down[which RARELY happens]. so the way i see this, the gun range is the one imposing on the long time property owner.

    If you move next door to an airport or gun range you are an idiot and should have no right to complain.

    everyone has heard stories of the old time gun range being shut down or sued by new builders.....this is where the gun range is one wanting to move in

    While the gun shop has been there a long time the pistol range is new. So all the neighbors were there before the range, not after.

    Part of this that has me holding back on saying the gun range should have to get neighbor consent is where the complaining neighbor lives. The complaint is 1.5 miles away, claims they come closer when out in their 4x4s.

    So, what do the adjacent neighbors say? The people with homes or businesses right on the gun shop's property line?

    don't know from the reporting. will have to keep an eye on this. its only about 35 miles from my old home town back in Illinois. and my understanding its just beginning to trickle into the legal system

    SO if I lived on the 8 acres and shot all day and had my friends over to shoot what difference would it be?

    The man complaining owns 45 acres, the range is being built on 8 acres this isn't about someone shooting in your backyard.

    Depending on how much noise the 25 foot berms muffle perhaps some additional sound control measures may be necessary but when you live in the country shooting is part of the landscape. I have a neighbor who shoots clay pigeons with his bud's and it sounds like a war zone but he has 65 acres and I have 25 and as far as I'm concerned as long as his sound isn't busting my windows have at it.
    Why don't we go to school and work on the weekends and take the week off!

    if this is correct that he is a mile and half away and only comes by closer once in awhile on 4x4 then to darn bad

    As we say in Oregon, good land use rules allow you to do whatever you want on YOUR property.

    Bad land use rules allow your neighbor to do whatever he wants on HIS property.

    NIMBY is a funny thing to watch.

    We have a noise ordinance in Palm Beach County.Unless your property is zoned as such,U cannot make any disturbing noise after 10PM.
    It may just be a case of the range being closed by a certain time each night but,Who knows..

    I'm 2 miles from the hwy. 25 race track (dirt) I can here them plain as day from here on friday night. I feel for those living 1/4 mile or closer. personally I wouldn't buy property close to the track but I'll bet anything when something is for sale close by the seller "forgets" to mention it.[:(!]

    Of course the Realtor just shows the place when the track isn't open!
