got taken/rant

first off, this is just a rant/letting off some steam, pissed off[:(!]ordered some ammo on GB side guy said it was 200rnds 357 jhp,so i email and ask why one picture of 1 box and if the other was the same
.he said yes. well got ammo yesterday 1 box of picture and 2 boxes of solid nose ammo. sent email to refund 15.00 bucks for difference of quality,no word/responce yet. will keep ammo but it's the principal of the matter.it would cost more to send it back and no telling if he would send money back , i don't think so.i consider it as theft lieing cheat sorry bass-turd[:(!][xx(] for all that have kept up, i do not want comp. or revenge,or do i hold GB in any way responsible. I JUST GOT TOOK, I STILL HAVE 200RNDS , NOT WHAT I WANTED BUT THATS O K. WILL [?]/ ask MORE [?] NEXT TIME, let that be a reminder for you when you are bidding.

    If you have e-mail proof to what you say, and I'm not doubting you at all, then open a claim with auction support. The seller will be responsible to refund all monies involved. I'm talking about shipping both ways. Wait until you have funds in hand for the item and to/from shipping before sending back.

    since you didnt specify the timeline that this has taken place over, i cant really speak to whether this is a justified rant yet.

    lets say for example you just got the ammo yesterday. the guy had a lot of boxes ready to go out and screwed up packaging yours. maybe he was sick or out of town on business yesterday or whatever and hasnt been able to respond. and maybe just maybe he'll send you the proper ammo and let you keep the wrong stuff by way of apology. in that case, i would say you're jumping the gun.

    now, if you got the ammo a week ago and have sent him a dozen messages and not heard a word back, that changes things. he could still be out of town, in the hospital etc; but you'd think he's be able to fire off a quick "im sorry. i effed up. i'll make it right next week after xxxxx".

    reserve not met

    so how is gunbroker involved????

    do i need to take a crazy pill or did you do the transaction outside of gunbroker?

    The auction states 200 rounds of 357 ammo. It doesn't say what kind. The fact that he had a pic of JHP would make someone believe that all 200 were JHP. I think this was done purposely. Since you pointedly asked him and he said all 200 were JHP makes him a liar. You will have a hard time getting any money back from him. As someone else pointed out the auction is listed as closed with the reserve not met. If you did a transaction outside of GB I think you're SOL.[V]

    it was auto relisted and then he emaied with :quote: since you were high bidder on last auction i will sell for that price and i agreed and then he took it off the other listing #216314908 (14 day auction and he ended it cause he sold to me).and the heading is listed as jacketedhollowpointquote:Originally posted by mt3777

    has the question of whether this auction was completed on or off the books been answered yet, because if it was completed off the books then you two both took money out of captfuns pocket and that makes you a thief too...

    if the auction wasnt completed through gb, they didnt get their fees. if they didnt get their fees, then you used their service without due compensations.

    to my eyes, a buyer that participates in an off the books deal is at least partially to blame for it happening. the brunt of the responsibility remains with the seller because you are right in that it is the seller who has to pay the duty to GB; but the buyer that completes a transaction outside of gb has to own their piece of the pie.

    in this case, i doubt you'll find much of a resolution as its clearly stated in the rules that off the books deals cant be controlled by gb. tough cookies. maybe you'll be a better member of the community next time.

    I see nothing wrong with what Noah did. He wasn't the one to contact the seller to buy off auction. The seller contacted him. It's the sellers responsibility to make good with GB since he was the one who initiated the dealing.

    From the gunbroker guide lines.

    To be eligible for Buyer's Protection coverage you must be the winning bidder of an item as defined by our User Agreement. 'Side Deals' in which you were not the winning bidder, items bought or sold through the 'Want Ads', and any other transaction in which you were not the winning bidder of an auction here are not eligible for Buyer's Protection. Damage sustained in shipment is not covered by the Buyer's Protection; it is the seller's responsibility to insure the item against damage in shipping.



    I personally don't care who initated the side deal, If you didn't actually win an auction and gunbroker doesn't get it's money, I would not be on the forums ranting about it.

    All your emails have nothing to do with winning an auction. In an earlier post you said the seller closed the auction and sold the Item to you. Side deals are a NO NO and I would not be on GD ranting about it.

    Definitely a NO-NO!!! You completed the auction outside of GB..........Caveat Emptor. If the seller is a stand up guy, he'll make it right, if not, your SOL. It happens. It could be worse, atleast its still .357 ammo.
