Can they legally let you go while you are still on medical restriction?

yes under FMLA only provides for 12 weeks unpaid leave.

caveat, his State law may be different, but most follow FMLA

Yea thats what they said i had 12 weeks. Its ok i expected that. Missing over a year and i might not never go back to work. I only have a 20 percent chance of living 2 years anyway. David

Best wishes to you and your family.

My prayers are with you, David. Deal with the medical issues first. And remember that family always comes before job. You can always get another job later.

You said they give you a "20 percent chance of living two years." Heck, in two years several of us will be gone -- most without a heads up. Not to diminish your battle with cancer.

Note: God is bigger than cancer. He's bigger than joblessness also. Just give it all to Him, love your family, and fight with everything you've got.

Keep us posted on how you're doing, and let us know when you need prayer.

Hang in there man. My stepmom has cancer and they gave her 2 months to live...that was over a year and a half ago, btw. The docs aren't in charge of those things.

There is nothing i can do i dont have any energy. There are 11 steps on the front of my house my legs are like jello when i go down them. David

Hey, sorry to hear when anyone gets cancer. I was diagnosed with cancer AML in 2006, at that time the rates of survival were 30% to live 2 years or more. Here I am 3years plus and I thank God every day that I wake up for the extra time. I also lost my job and ended up 50k in the hole but I still refused to give up. Things have a way of working out, they can never be the way they were.
    God bless

When I worked in St. Louis for The Evil Empire, there was a guy who stepped, fell, jumped,...whatever from a skidloader tire to the ground. He had a soft back and that put him over the edge. He landed on his feet for what it's worth. He required back surgery. Then there was an infection. I don't know how he turned out, but he was a heck of a nice guy.

Their union contract said 12 months out of work and automatic termination.

The letter was sent to him by registered mail. Man, that's low.

Dave- first- are you eligible for disability from Social Security, and have you applied for it? Need to take care of the frijoles.

Understand the physically infirm part- but a question- is there somewhere around you that you may be able to teach what you know to others? Apprenticeship program, community college, etc. Not just income, but keeping your brain occupied is good therapy.

As far as the 2 years- it could be. Doc's get an education, but not a crystal ball. So, assuming you DO have 2 years- what do you want to do with it?

And prayers and best wishes for you and yours sent Stay in touch, bro- let us hear from you.
